Reliable sources have informed that Enforcement Inspector Shiv Kumar has been suspended on account of dereliction of duty and that Dr Ashok Kumar husband of Dr Jyotsana has also been served BOCA notice under JMC Act 2000 under section 253 and that today on 23-5-2024 JMC enforcement team seized drilling machine with which existing lantern on first floor was being broken but such a delayed action when basement ,ground and first floor construction stands completed is highly questionable

Jammu Municipal Corporation neither performs its duty nor it acts on complaints of whistle blowers and Social/RTI Activists resulting in steep rise in violated constructions within Municipal areas and particularly in Zonal planned Housing Board colony. The live example of this is ongoing unauthorized construction by Dr Jyotsana after dismantling two existing double story shops measuring nearly 1000 Sqft purchase land recently without getting site plan approved from JMC falling under Khasra No. 24 Min, Khata No. 57 and Khewat No.3 adjoining with her ongoing construction of multistory nursing home in Ward-52 , Satyam Road Extension Trikuta Nagar Jammu.
To put the things in right perspective, Dr Jyotsana wife of Dr Ashok Kumar to fulfill his unfair desires of modernizing existing shops without getting JMC permission started construction of basement on RCC pillars and slowly dismantling existing shops covering hundred percent area and even covering road area of Irrigation department with the help of enforcement staff. The owner continued unauthorized construction despite bringing this violated construction into kind notice of enforcement staff by aggrieved locals before area Enforcement Inspector Shiv Kumar who didn’t take any action against owner despite publishing a detailed story in print media dated 8-5-2024 along with pictures but nothing happened on ground and violated construction continued. As a result of which the slab work on first floor stands completed and simultaneously breaking down existing lantern on two shops.
Reliable sources however informed that Enforcement Inspector Shiv Kumar has been suspended on account of dereliction of duty and that Dr Ashok Kumar husband of Dr Jyotsana has also been served BOCA notice under JMC Act 2000 under section 253 few days back to make his stand clear on violated construction within seven days but construction meantime continued and that today on 23-5-2024 JMC enforcement team along with new Enforcement Inspector deputed in place of Shiv Kumar Ashwani Kumar seized drilling machine with existing lantern was being broken along other equipments which deserves appreciation but at the same time question arises why such a delayed action when basement ,ground and first floor construction stands completed.

The callousness of JMC enforcement staff is evident from the fact despite bringing construction of basement, ground and first floor on RCC Pillar was duly brought into kind notice of enforcement staff at its initial stage but no befitting action taken by them resulting in good percentage completion of structure. As a result of which, the owner continued construction and when slab work being done on first floor using slab laying machine, the photographs of same along with relevant details were sent on whatsapp numbers of Enforcement staff on 2-5-2024 seeking immediate action and to stop slab work on first floor on existing basement and ground floor but nothing was done and slab work completed with the help of enforcement staff.
Worthwhile to mention here that Dr Jyotsana Sharma wife of Dr Ashok Kumar Sharma already running a hospital under name and Style SDDM Hospital on a piece of land actually allotted for Nursing home in Sector-2, Channi Himmat Housing Board colony and also not using sanctioned basement for commercial purposes and infect running laboratory and the patients and their attendants park their vehicle on road. Now as a part of further expansion of hospital, Dr Jyotsana wife of Dr Ashok Kumar Sharma has started another construction of multi-story commercial nursing home along with basement falling under Khasra No.69 (New) earlier it was under Khasra No. 690, village Channi Himmat , Ward-52, Satyam Road Extension Trikuta Nagar having total land area 1515.05 Sqm and accordingly paid Rs 1788750 as land use change fee before JDA. Any way Dr Jyotsana got approved site plan stage-1st approved from JMC vide No. 787/JMC/BS/2023-24 dated 21-7-2023.
In light of the above , Commissioner JMC should spare some time for his office to visit such sites and mustn’t put everything on enforcement staff who are already towards the side of violators. How long print media will remind enforcement staff to perform its duty and when will they perform their duty honestly and as per Unified Building Bye-laws 2021 and JMP-2032. Unfortunately as a result of which there is absolute boom in unauthorized constructions of which Commissioner JMC has failed to take serious cognizance of resulting in serious loss of sincerity and credibility on part of JMC besides serious loss to govt exchequer.

- JMC’s unfair functioning makes written undertaking by owner pledging to demolish violations more powerful than BOCA demolition notice under Section 7(3) as witnessed in case of residential house 203/2 on main road side Channi Himmat Ward-50 stopping proceedings under demolition notice when owner didn’t remove violations of converting residential porch into commercial shop which results in restart of whole of residential ground floor as commercial just before Diwali 2024 running garments business under name & Style, “RK Fabrics”
