Owner as per approved site plan didn’t construct kitchen , bedroom with attached toilet , lobby and raised three commercial halls with provision of ramp and elevator absolutely contrary to approved residential plot but sadly JMC from initial stage to present stage of completion of three commercial floors didn’t take any action and extended every possible help to owner to raise violated construction.
As per report of Surveyor dated 26-9-2023 reported that plot is vacant at the time of inspection. As per report of Dy General Manager dated 9-10-2023, Housing Unit No.1 , the plot is enclosed with boundary wall and columns raised with no excess area. However as per report of Building Officer Kapil Sharma dated 30-10-2023 the plot is vacant at the time of inspection and that proposal for ground plus two residential house conform to Unified Building Bye-laws 2021 and JMP-2032 norms.
Building Officer Kapil Sharma despite admitting no provision of Ramp and its specification in residential building in Unified Building Bye-laws 2021 approved site plan which should have been rejected after witnessing provision of ramp and elevator in residential approved site plan deliberately ignored provision of ramp to support owner in raising construction of hospital complex from residential plot in residential area.
Moreover then Senior Town Planner JMC Sunil Abrol who retired on 30-11-2023 also ignored provision of ramp in case of residential construction on three floors which has only been observed in case of hospitals and nursing homes which only means that all the concerned officials were on same page to somehow allow owner to raise construction of hospital from residential house without any provision for parking purposes which is pre-requisite need in case of commercial construction
Adjoining residential plot 211/7 Channi Himmat Housing Board colony measuring 40×80 sqft also belong to Kohli family in the name of Kailash Kohli s/o Roop Narayan r/o 87 A/D Gandhi Nagar Jammu which was allotted by Housing Board on 18-5-1989 which ends every doubt that this is construction of hospital which can be very easily clubbed to ensure construction of hospital from residential plots that too without any parking purposes and without maintaining mandatory setbacks.
Moreover Smt Shukla Kohli’s son Ashwani Kohli s/o late Kailash Kohli is already running AK Health care from rented accommodation in Guru Nanak Complex Channi Himmat Jammu in Sector-3 offering 15% discount on all allopathic medicines, surgical, baby food and diapers besides A-grade Ex Surgeon Dr Subash Abrol(MS), J&K Health Services Consultant Surgeon, GMC Jammu remains available here from 10 AM to 11AM daily and there is every likelihood that owner must be thinking of raising hospital building to shift from present rented accommodation to own hospital

JMC has made the mockery of significance of approved site plans as it is allowing owners to raise their choice constructions at the cost of JMP-2032 and Unified Building Bye-laws 2021 and also badly damaging well laid symmetry of planned Housing colonies particularly in Channi Himmat Housing Board Zonal planned colony. To put the things in perspective, Smt Shukla Kohli wife of Late Kailash Narayan Kohli r/o 87 A/D Gandhi Nagar Jammu purchased a residential plot No. 212/7 Channi Himmat Housing Board colony, Ward-50 measuring 40×80 (3200) Sqft from original alottee Vijay Gupta s/o Hans Raj Gupta r/o 728-A Gandhi Nagar Jammu for residential purposes. The same got registered in Court of law on April 8th 2009 and accordingly the owner paid Rs 32000 as transferee fee thereafter applied for building permission from JMC Dated 20-2-2023 vide application No. 4184 for ground floor plus two floors 163.45 Sqm (1759 Sqft) Sqm each for residential purposes. The owner also managed to get free lease hold rights of the plot. The owner was mandatory to follow setbacks including front side 4.11 mtr (14 ft) , back side 2 mtr (6.5ft), side-1, 2 mtr (6.5 ft) . The height of building was fixed as 10.20 mtr (33.5 ft) excluding Mumty from front road level . The owner accordingly paid building fee Rs 22028 for permitted residential construction. Surprisingly the approved site plan has the provision for ramp measuring nearly 10 ft on three floors and also towards left side there was also provision for foyer (Elevator) to reach third floor from ground floor which is not at all seen in residential buildings and prominently it is observed in case of hospitals/ Nursing home and the same nowhere mentioned in JMP-2032 and Unified Building Bye-laws 2021 in case of residential construction.
Further as per approved site plan , the owner was supposed as per residential approved site plan to construct ramp towards right side then kitchen , bedroom with attached toilet , lobby and also foyor (Elevator) to move from ground floor to third floor . But the owner didn’t construction anything as mentioned above and proceeded towards complete commercial construction without any internal partitions and left space for windows on all three floors to look like wards later on and that too towards side of residential plot 211/7 which no owner accepts which clearly means that this residential plot also belongs to Kohli family . Moreover the front entry is more than 20 ft which is rarely seen in case of residential construction. However it deserves mentioning here that application was rejected by Housing Board and hence approved site plan was also rejected. Meanwhile the owner after no NOC granted by Housing Board didn’t apply for afresh and instead started construction at the site without JMC permission. The management of Golden Yug daily English Newspaper in this regard published a detailed story dated 15-9-2023 along with pictures after locals aggrieved of unauthorized construction approached this office with relevant details. This prompted then Secretary JMC and then Enforcement Inspector Ram Khajuria visited site and stopped unauthorized work without JMC permission but by that time the owner had already raised RCC Pillars at the site without Maintaining setbacks and asked owner stop raising construction until he gets site plan approved from JMC. The owner applied for fresh site plan approval from JMC vide Submit No. JMC/2023/6247 dated 26-9-2023.
Anyhow the reports prepared by Surveyor, Building Officer and Dy General Manager were having serious contradictions as in one report there was mention of columns raised at the site and another report mentions plot is vacant. It is pertinent to mention here that as per report of Surveyor dated 26-9-2023 reported that plot is vacant at the time of inspection. It deserves mentioning here that the owner absolutely contrary to approved residential site plan raised commercial construction of three big halls and with provision of ramp and elevator in approved site plan, it is without any doubt a construction of a hospital complex and by no means it is a residential construction from number and size of windows which are rarely seen in case of residential house besides front entry measuring nearly 20×10 ft in size. Moreover the four big windows were kept towards side facing residential plot 211/7 and when thoroughly investigated, it was found that residential plot 211/7 Channi Himmat Housing Board colony measuring 40×80 sqft also belong to Kohli family in the name of Kailash Kohli s/o Roop Narayan r/o 87 A/D Gandhi Nagar Jammu which was allotted by Housing Board on 18-5-1989 which ends every doubt that this is construction of hospital which can be very easily clubbed to ensure construction of hospital from residential plots that too without any parking purposes and without maintaining mandatory setbacks. This creates strong likelihood that after clubbing of both these plots there will be construction of hospital as raised structure in no way a residential construction as there are no windows, ventilators, doors which are vital parts of residential house and thus making land use change openly and brazenly with help of concerned enforcement staff who as on date didn’t take any action against owner from initial stage to present stage wherein three floors commercial structure is almost ready what to think of serving any BOCA notices under provision of JMC Act 2000 which tantamount to serious nature dereliction of duty which should be taken care of henceforth.
Moreover as per JMP-2032 and Unified Building Bye-laws 2021, the owner was entitled to 55% construction of total plot area but owner at the site has raised construction covering nearly 80% plot area that too without maintaining setbacks and as on date construction is going on. Worthwhile to mention here that the site plan for any sort of construction be it residential or commercial holds great significance as it is approved as per the guidelines of JMP-2032 so that planned residential colonies don’t have to go through any sort of mess later on. In this regard it is the prime duty of Jammu Municipal Corporation to look into every aspect and after ensuring that other concerned departments don’t have any objections besides ensuring every construction in accordance with approved site plan right from Plinth construction to slab work at each and every stage of construction for which Enforcement staff has been given responsibility to supervise all ongoing constructions in Planned residential colonies and it is their responsibility to bring the same before the notice of concerned authorities for action against violators timely and properly. It becomes important also as right now Jammu city is heading towards becoming smart city and if, it has to become a reality then you can’t tinker with planned colonies.
