Under public pressure and somehow to save their skin, Enforcement staff led by Anil Kashyap and concerned Enforcement Inspector in Channi Himmat area today on 12-10-2024 afternoon sealed newly installed big shutter as an eyewash action when the entry to recently converted residential floor into commercial hall in shape of glass shutter is still open and commercial activity is still going on and also the shutter was sealed when whole of the residential ground floor has already been converted into commercial hall. Had the JMC enforcement staff taken action when the ground floor was being converted into commercial hall, the owner would not have been allowed to convert residential ground floor into commercial one against JMP-2032 AND Unified Building Bye-laws 2021.

JMC must remember that running a commercial entity in a residential area does cause nuisance, environmental pollution due to ingress and egress of customers vehicles and disturbs the peace of the residents of the neighborhood thus affecting the quality of air, causes noise pollution and thus affects the right to life of the residents in the area as guaranteed by Article 21 of Indian Constitution
Conversion of residential house into commercial one is new trend prevailing in Channi Himmat Housing Board Zonal planned colony as the rate of commercial properties is touching sky in recent times and every influential owner of residential house taking into confidence concerned enforcement staff resorting to conversion of residential house into commercial one in sheer breach of lease deeds of Housing Board and also against JMP-2032 and Unified Building Bye laws 2021.

Notwithstanding aggrieved residents of Channi Himmat Zonal Planned colony running from post to pillar to stop commercialization Housing Board Colony Channi Himmat ,JMC Higher-ups and particularly JMC Enforcement staff is hell-bent to swiftly turn this housing colony into commercial hub like Gandhi Nagar and Shastri Nagar by supporting and extending unfair patronage to violators in lieu of illegal gratification. This in turn has made BOCA notices under JMC Act 2000 and approved site plans have become laughing stock within JMC jurisdiction. JMC even takes no serious cognizance of violations getting duly published in print media every now and then along with relevant details and pictures.
To put the things in perspective this newspaper published a detailed stories dated 21-8-2024 and 12-9-2024 along with pictures that that One Ashok Gupta s/o Rattan Chand Gupta owner of corner residential plot 274/3 (2117 Sqft) Channi Himmat Housing Board colony in Ward 50 on main road side of Colony in front of Luthra Academy with two floors ground floor measuring
1900 Sqft without aintaining setbacks and first floor measuring 1500 Sqft residential having front road side measuring 20 ft and main road of colony nearly 60 ft towards other side of residential house already running unauthorized small sized commercial shop measuring 200 Sqft and running Atulya Laboratory and Lovely Medicos and Lab on ground floor of his residential house where he resides having lobby, drawing room and kitchen has started converting whole of residential ground floor into full-fledged commercial hall after dismantling lobby, drawing room and kitchen by removing all the supportive walls but sadly JMC didn’t take any action against owner despite strong resentment by immediate neighbours and adjoining locals.
Now the owner three months back encouraged by support of JMC enforcement staff has started framing small cabins on whole of residential ground floor by completely dismantling residential ground floor into full-fledged commercial hall with proper fitting of big shutters and also constructing new shop by removing windows and door of existing drawing room. When then concerned Enforcement Inspector Ashwani Kumar was asked how owner of residential house can convert whole of residential ground floor into commercial one without JMC permission which was also not within jurisdiction and competency of JMC to permit owner of residential house into commercial one, the enforcement staff replied that the owner has been asked to produce relevant records and claimed that the owner was also served to owner under JMC Act 2000 to somehow kill the time and to extend time to owner to complete conversion of residential ground floor into full-fledged commercial hall as the ongoing conversion work to commercial was not stopped for even a one day and claimed notice served to owner seems mere eyewash seems mere eyewash. It is highly surprising that Enforcement team led by Enforcement Officer Anil Kashyap along with concerned Enforcement Officer Rattan Lal though visit Channi Himmat area every now and then but sadly don’t take deserving action and return back without taking any action and cognizance of ongoing unauthorized constructions.

Worthwhile to mention here that , JMC’s no action when conversion of ground floor into commercial one was going on despite bringing the same into their kind notice and also highlighting conversion in print media, concerned JMC enforcement staff didn’t take any action against owner and as a result of which owner on 10-9-2024 midnight fitted big shutters on front side of residential ground floor and openly and brazenly declared full-fledged commercial hall on residential ground floor in presence of earlier Enforcement Inspector Ashwani Sharma and now in presence of Enforcement Inspector Gagan Kumar who was on leave and later suspended under the overall support of Enforcement Officer Anil Kashyap deputed in Channi Himmat area.
It deserves mentioning here that the owner has also raised violated residential construction by not observing mandatory setbacks and now completely converting residential ground floor into commercial will create more traffic nuisance for residents in the area as there is absolutely no parking facility at all. Dy Commissioner South incharge Channi Himmat area must seriously introspect and work on loop holes in the system being badly exploited by Enforcement Officer and Enforcement Inspectors so that these serious nature violations can be curved and so that every construction whether residential or commercial constructions are undertaken strictly as per approved site plan and also so that no one can dare to raise any nature construction without approval of site plans from JMC.
Otherwise no relaxation will be enough to implement JMP-2032 and Unified Building Bye-laws 2021. The most evident example of this is this present story where owner firstly constructed small sized shop and now completely converted ground floor residential into commercial hall paving way for four new shops by completely dismantling existing residential ground floor and has already started commercial activity from residential house.
