DB issued notice to Director Estates in contempt petition

[ May 02, 2017 ] In a Contempt Petition filed by a Specially Abled Lawyer Suraj Singh (who is 100% visually impaired) a Division Bench of the State High Court comprising Justice Alok Aradhey and Justice Janak Raj Kotwal issued notice to Dr. G.N. Itoo, Director Estates, J&K Government in the first instance, however the Division Bench deferred notice to Ms. Mehbooba Mufti Minister Estates, J&K Government at this stage. After hearing Advocates S.C. Gupta and Sheikh Shakeel Ahmed appearing for the petitioner, the Division Bench issued notice to the Director Estates, J&K Govt. returnable within four weeks. Advocate S.C. Gupta appearing for Specially Abled Lawyer Suraj Singh submitted that a Division Bench of the State High Court on March 06, 2017 had issued directions to the Minister Estates, J&K Govt to take a decision in the matter in view of the interpretation given to Regulation 4(e) of J&K Estates Department (Allotment of Govt. Accommodation) Regulations, 2004 in respect of the entitlement of Advocate Suraj Singh for accommodation within a period of 04 weeks. Advocate S.C. Gupta further submitted that despite the expiry of 04 weeks the Minister Estates, J&K Govt has miserably failed to comply the directions of the Division Bench as till date the order of allotment has not been issued in favour of the petitioner. Advocate S.C. Gupta further submitted that the petitioner is in litigation for the Govt accommodation since 2011 and has already won two rounds of litigation and initially the Single Judge on October 05, 2016 allowed the writ petition and directed the Minister Estates, J&K Govt to take a decision with regard to the allotment of Govt. accommodation in the light of the interpretation given to Regulation 4(e). Advocate Gupta further submitted that this judgment of the Single Judge was challenged by the State Govt before the Division Bench and the same was upheld and directions were issued to consider the case of the petitioner within 04 weeks. After considering the submissions of Advocate S.C. Gupta and Sheikh Shakeel Ahmed appearing for the petitioner Advocate Suraj Singh, the Division Bench of the State High Court comprising Justice Alok Aradhey and Justice Janak Raj Kotwal issued notice to Dr. G.N. Itoo, Director Estates, J&K Government in the first instance returnable within 04 weeks, however the Division Bench deferred notice to Ms. Mehbooba Mufti Minister Estates, J&K Government at this stage.
