[ May 02, 2017 ] In a much publicized Public Interest Litigation regarding construction and extraction in River Tawi, Division Bench of State High Court Comprising Justice Alok Aradhe and Justice Tashio Rabstan after hearing battery of lawyers observed that Sr. Adv Sunil Sethi submitted that the directions issued by this Court vide order dated 17.11.2016 whereby Division Bench directed on November 17, 2016 that Bench directed State shall also identify all constructions coming and falling on either side of River Tawi, from its fringe line, either government or individual, whether such construction/s is/are authorised/unauthorised, and prepare a list of such construction/s, so that such constructions are removed and those constructions, which are authorised one, shall be compensated and rehabilitated at some other place, as has been done in case of Dal Lake dwellers. The list of all such constructions shall be prepared within fifteen days from today and thereafter the process for removing and rehabilitation shall be undertaken within a month’s time have not been complied with.Upon this Division Bench directed Divisional Commissioner, Jammu, to remain present in this Court on 09.05.2017 to apprise this Court with regard to the direction of order dated 17.11.2016. Division Bench further observed that this Court by an order dated 28.12.2016 has directed the constitution of the Committee comprising Sh. A. K. Koul, the then Registrar General of this Court as well as Sh. Parvinder Singh, DIG (Retd.) to inspect the area(s) of the subject matter of instant PILs as well as for submission of fortnightly reports to the Registrar Judicial, High Court of J&K, Jammu. Since Sh. A. K. Koul, has already demitted the office of Registrar General and is not available, therefore, fresh Committee to oversee the direction and to ensure the implementation of the orders issued by this Court from time to time, is required to be constituted. Therefore, we are inclined to direct the constitution of the fresh Committee comprising Ashok Kumar Sharma, retired District Judge, Parvinder Singh, retired DIG and Sudershan Sharma, Advocate, who has voluntarily to be a member of the Committee on honorary basis.
