Bail of two rape accused rejected

[ May 29, 2017 ] Jammu: Presiding Officer Fast Trac Court Kishore Kumar rejected the bail application of Ashok Kumar and Balwinder Singh in rape case.According to the prosecution story is that on 22.04.2017, complainant has filed an application stating therein that Ashok Kumar R/o Gorkha Nagar is family friend, who used to come to her house daily and told my parents that she is suffering from some evil superstitiously weak and she needs a treatment and in doing that he sexually harassed and raped her and when she raised voice, he and his real brother threatened her and started physically torturing and beating her. On this report FIR NO. 41/2017 for commission of offence under section 376 RPC has been registered.Presiding Officer Kishore Kumar after hearing both the sides observed that in view of the recent incidents of crime against women, particularly, incident of rape of minor, the courts have already sounded that precaution is to be taken by considering the bail please of the offenders of such heinous crime. It has been impressed upon the Judicial officers and Sessions Judges dealing with such cases to take care and caution in exercising discretion to consider their release or otherwise of accused on bail pending investigation and trial, lest the discretion so exercised adverse the societal interests, investigation and fair play for fair trial”. With these observations Court rejected the bail application.
