Prosecution failure leads to acquittal in forgery case

[ June 15, 2017 ] Jammu: 2nd Additional Sessions Judge Jammu Pawan Dev Kotwal while deciding 16 years old case, acquitted one Sanjeev Kumar s/o Bodh Raj R/o Chakroi, Tehsil R.S.Pura who was challaned by the police in forged school certificates.According to the police case that on 02.07.2001 at 15.30 Hrs while police personals were on patrolling and during patrolling at Chakroi he received an information from reliable source that Sanjeev Kumar @ Dimpi s/o Bodh Raj caste Kashap Rajput fraudulently forges school leaving certificates of different schools and has manufactured stamps of many schools and also forged school leaving certificates and has kept in his possession. On this information he searched the house of Sanjeev Kumar @ Dimpi and recovered nine stamps and fake school leaving certificate forms from his house which he has kept in his possession to use illegally and fraudulently but accused succeeded in fleeing away. Accused has committed the offences u/s 467/468/419/420 RPC. After completion of investigation challan was presented.2nd Additional Sessions Judge Jammu Pawan Dev Kotwal after hearing both the sides observed that in the absence of such evidence to establish that specimen signatures and writings compared by the FSL with questioned signatures and writings on the certificates were of the accused and accused only, prosecution case fails on this count also. With these observations court held that prosecution has failed to establish charge against accused beyond reasonable doubts and therefore, challan is dismissed and consequently accused is acquitted of the offences u/s 467/468/471/472/474/420 RPC.
