Accused booked in NDPS Case denied bail

[ June 17, 2017 ] Jammu: The Hon’ble Court of Addl. Sessions Judge, Doda, has rejected the bail application of the accused, namely, Hans Raj S/O Ram Singh R/O Shamthi Tehsil Kastigarh District Doda, involved in a case under the NDPS Act which pertains to an incident which took place on 08.02.2014 when 166 charas balls weighing about six KG came to be recovered from him by the Police of P/S Doda at a naka point laid near Dak Banglow Doda when the accused was travelling in a matador bearing registration No. JK02T-0667 towards Doda town regarding which incident a formal FIR was registered at P/S Doda. The police concerned investigate the matter and sent up the accused for trial before the concerned trial Court.While rejecting the bail application, the trial court inter alia has held that out of the 21 PWs, 12 have been examined all of whom have stated that charas came to be recovered from the possession of the accused. The Court also held that NDPS Act was a special legislation which have enacted to make strict provisions for control and regulation of operation relating to Narcotics and Psychotropic substances and their use and illegal trafficking. The court has also held that the society at present is under severe threat from drug abuse and trafficking of contraband. As per the Hon’ble Court passed in the matter, there are no reasonable grounds for believing that the accused is not guilty of the offence thus no case for bail has been made out by the defence counsel. With these observations, the Hon’ble Court rejected the bail application moved by the accused through his Counsel Sh. Mirza Kabir Beg, advocate, whereas the State was represented by the Ld. Addl. Public Prosecutor Doda, Sh. Arshad Hafeez Salaria.
