[ June 17, 2017 ] Doda : The Hon’ble Court of Addl. Sessions Judge Doda has rejected the bail application of accused, namely, Jai Paul S/O Jagdev Singh R/O Charota, Tehsil Assar, District Doda, inter alia, holding that in serious offences where the victim levels charges of rape against the accused, the court must ensure that the accused should be behind the bars till the statement of the prosecutrix is recorded. The Hon’ble Court observed that since, as per the prosecution evidence adduced in the matter so far, the accused had extended threats to the prosecutrix, so he was not entitled to be enlarged on bail as the statement of the prosecutrix is yet to be recorded at the trial. The Hon’ble Court has further held that there is no denying the fact that the liberty of an individual is precious and is to be protected by the courts. Nonetheless such protection cannot be absolute in every situation. The valuable right of liberty of an individual and the interest of the society in general has to be balanced. With these observations, the Hon’ble Court rejected the bail application moved by the accused Jai Paul through his Counsel S.A. Hashmi, advocate, whereas the State was represented by the Ld. Addl.
