Jammu region continuous to suffer discrimination in selections JKPSC terms State Rule Book as untouchable

[ June 27, 2017 ] The J&K Public Service Commission (JKPSC), which pledges to “exercise utmost impartiality, objectivity and efficiency in accomplishing its tasks”, has been facing a serious credibility test after reports of forgery of policy documents and denial of marks for correct answers in the prestigious Kashmir Administrative Services (KAS) examination came to the fore. It seems that whole of the JKPSC losing ground of credibility with every passing day. Now it has come to fore that four candidates namely Ravinder Mohan S/o DK Verma, Brij Bhushan Singh S/o Munshi Singh, Shahid Farooq Khan S/o Farooq Ahmad Khan were regularized as Computer operators in the pay scale of 5200-20200 plus grade pay Rs 2400 and Sajad Ahmad Shalla S/o Abdul Ahmad Shalla regularized as Junior Assistant in the pay scale of Rs 5200-20200 plus grade pay Rs 1900 by J&K Public Service Commission vide order No. 45-PSC of 2016 dated 8-3-2016 issued by former Secretary JKPSC Shakeel-ul- Rehman who has a dubious character so far during his tenure in PSC and particularly let down aspiring candidates of Jammu region by sacrificing rules to accommodate the candidates of choice. Computer Operators were given grade of senior Assistant out of way by then Secretary Shakeel-ul- Rehman. Not only this he was recently transferred from PSC in the Finance Department following complaint against him but soon his order modified and again transferred and posted as Addl Secretary Home to save his skin and skin of PSC including Hakim Ghulam Zeelani and Mushtaq Ahmad Bhat after an FIR was lodged against him in Crime Branch after wild protests regarding their roles in ending credibility of PSC by ignoring meritorious candidates and choosing their choice candidates. It deserves mentioning here that the above four candidates were engaged without following any codal formalities at the first place now their regularization even when they have not completed their requisite time period which is mandatory to get the services regularized in state. Two of the candidates have even not completed 7 years services at the time of regularization of their services. Technically speaking, Chairman, PSC and Secretary PSC have regularized above candidates beyond their jurisdiction as they were not competent to take such a decision. Whereas for such decisions, there is already Empowered Committee constituted vide J&K Civil Services Special Provision Act 2010 dated 28-04-2010 having members comprises of Administrative Secretary, Finance Department as convener, Administrative Secretary, GAD as member, Administrative Secretary of the concerned department as member, Director, General Accounts and Treasuries as member and Director Codes, Finance Department as Member Secretary. The department shall with in sixty days from the commencement of this Act, refer all the cases of adhoc or contractual or consolidated appointees eligible for regularization under section 5 to the member Secretary for being placed before the Empowered Committee for scrutiny and verification with regard to their entitlement to regularization under this Act. But the regularization of above four candidates was done contrary to this act . It is also suspicious to note that the minutes of the meeting of DPC was held on 29-08-2014, however regularization done on 08-03-2016 after the time period of nearly two years. Moreover it is questionable as to why the previous Commission delayed it for two years as the constitutional body had become completely defunct since November 16, 2014 after the retirement of its last member, K B Jandial. However new team of JKPSC under the Chairmanship of Abdul Latief Deva took oath on 23-07-2015 appointed by BJP-PDP coalition Govt. After taking over reins of power, the present Government had initiated process for filling up vacancies in J&K PSC, which had become defunct last year. When S. L. Bhat retired as Chairman of the Constitutional body in September 2014, the process of recruitment had come to a grinding halt with over 2800 posts remaining unfilled by getting stuck at various levels in the Commission. Despite persistent protests by political parties and students alike, no change of any improvement and addressing the issue of discrimination that has always been alleged by Jammu region candidates in selection have not been addressed. In this regard a writ petition is already filed in High Court vide Writ OWP No.892/2016, MP No. 1/2016 by Shubham Sharma and others. J&K Public Service Commission (PSC) has been in news again for its alleged favoritism and lack of transparency. Mainstream media as well as social media has been criticizing the commission for its wrongdoings. While the unemployment graph in Jammu and Kashmir continues to swell, the state government’s re-employment policy for ‘favourite’ civil servants is furthering joblessness in the state and also telling upon the health of administration. Among other members who have already spent considerable time even some getting undeserving extensions having no significant role in Commission doing much of damage already is Javed Punjabi who at present working as head clerk in secrecy section in PSC and dealing all the accounts generated by JKPSC. The said employee is well versed with loop holes of system and very much responsible for wrong doings in PSC. The generated amount from sale of various forms by PSC from 1-4-2009 to 31-7-2016 was Rs 32041888 but there is no account of spending of this revenue so generated which is perhaps the main reason as to why nobody once engaged in any of the post doesn’t want to leave this station because of utilizing funds as per their wish without answering anybody. The worst use of public money can’t be witness in anywhere in J&K. The Commission which lacks power to appoint even a peon on its own, how it took such appointments ignoring all norms, Govt needs to answer which is being anxiously waited by discriminated youth of Jammu region.
