Vehicles in police custody for more than one week

[ July 08, 2017 ] Jammu, JULY-08-2017-(JNF):- In a Public Interest Litigation filed by Achyut Dubey who is a practicing lawyer seeking direction to respondents to ensure that applications for disposal of all the vehicles in custody of the police in the State of Jammu and Kashmir in connection with any offence for more than a week, except the vehicles in connection with which release applications filed before the concerned Court have already been decided, are made by the concerned SHOs/IOs concerned before the appropriate Court.A Division Bench of State High Court Comprising Justice Alok Aradhe and Justice Sanjeev Kumar after hearing Adv Achyut Dubey for the PIL whereas Sr. AAG WS Nargal for the state, granted six weeks time to file preliminary objections and counter affidavit.During the course of hearing Adv Achyut Dubey submitted that one moves along the national highway NH44/NH1A from Jammu to Srinagar or State highways, more particularly, when one passes by the police stations, police posts and the police Nakas anywhere in the State, it is quite common to find scores and scores of vehicles, some of them damaged in accident and some seized in various other types of crimes, lying there in dilapidated condition clearly suggesting that they have been lying there for quite some time, may be months or years together.
