JKPSC sabotaged aspirations and sentiments of meritorious students of state

[ March 23, 2018 ] Jammu & Kashmir Public Service Commission (JKPSC) remains in limelight for wrong reasons. Over the years, the Commission has brought bad name to it by resorting to favouritism, nepotism and pitting one region against another with highly discriminatory selection lists and also engaging employees on need basis in the Commission itself. All the posts right from peon to higher posts have always come under scanner bringing huge resentment among deserving candidates who are ignored to less qualified and less capable candidates due to biased selection process adopted by Commission. JKPSC has 14 posts of Orderly and two watchmen in pay scale of 4440-7440+ grade pay 1300 & were filled without following any of codal formalities & without advertising any of the posts. Worth mentioning here that Vijay Kumar S/o Rattan Chand R/o Hiranagar, District Kathua was engaged on casual basis in the Commission initially for a period of 89 days vide Order No.545-PSC of 2017 dated 23-3-2007 by under secretary, JKPSC and Is still continuing his services in commission . Similarly Syeed Fida Hussain s/o Sayeed Haider Hussain Shah was engaged initially for 89 days vide Order No.168-PSC of 2008 dated 30-5-2008 by Secretary JKPSC at Rs 6000 as wages per month. Both these casual workers were regularized on 30-12-2015 vide order No.217-PSC of 2015 where as one of the casual worker namely Vijay Kumar was only middle pass and minimum qualification for class IVth post was 10th & 12th passed communicated vide SRO No.99 dated 7-4-2008. Under Secretary, JKPSC there after vide Order No.166-PSC of 2016 dated 24-10-2016 again engaged two new casual workers namely Hamidullah Lone S/o Ali Mohd Lone R/o Lessu, Anantnag and Javaid Ahmad Reshi S/o Habib Ullah Reshi R/o Hamray Pattan Baramulla on need basis for a period of 89 days with the direction in engagement order that they will have no right to claim any substantive appointment. But the engagement which was made just for 89 days is still continuing and ultimately they too will be regularized through backdoor means. However Govt Order No.384-GAD of 2015, dated 17-3-2015 says that all the engagements/arrangements made by the different departments/public sector undertakings/boards/autonomous bodies under any scheme against sanctioned posts without any selection procedure, even on contractual basis shall cease to exist with immediate effect. Any other engagement/arrangement made by the departments/public sector undertakings/boards/autonomous bodies at their own shall be revoked. But JKPSC despite clear cut directive again commission engaged casual workers on their own acting contrary to Govt order of 2015. Moreover 4 vacancies of posts emerged either after promotion or retirement in the JKPSC, instead of advertising the posts, JKPSC regularized three computer operators namely Ravinder Mohan, BB Katoch, Shahid Farooq Khan and Sajad Ahmad Shalla as Junior Assistant vide order No. 45-PSC of 2016 dated 8-3-2016 issued by Secretary JKPSC who were engaged as casual workers .It deserves mentioning here that JKPSC Secretary was not empowered to regularize the services of three computer operators and one Junior Assistant and the same was mandatory to refer to Finance Department vide Special Provision Act issued on 29-4-2010 whereby it was mandatory to refer regularization cases to five member committee comprising of Administrative Secretary Finance Department as convener, Administrative Secretary, GAD as member, Administrative Secretary of the concerned department as member, Director General Accounts and Treasuries as member, Director, Codes, Finance Department as member secretary to see whether the codal formalities were followed in regularization process or not. Moreover Commission has no power to disperse wages from the revolving fund where the income is generated from the sale of different kinds of forms as per the guidelines of Finance department with the concurrence of GAD department vide Govt Order No.249-F of 2001 dated 24-10-2001. During the year 1-8-2015 to 31-7-2016 Rs 44114165 revenue was generated through sale of forms and other sources where as it has come to fore through investigation that this fund was misused by spending unfairly. Moreover refreshment charges of Rs 287700 incurred on remuneration for officers/officials including sweepers of the Commission for working beyond normal hours and on holiday/Sundays was released whereas Commission can’t use money from the revolving funds for refreshments. Under Section 133 of the J&K Constitution Public Service Commission is a constitutional authority which should carry its weight in all sections of the society as far as its impartiality and transparency is concerned to instil confidence in the people for whom it has been created and after Judiciary should command the highest respect. Though many voices have been raised for the last many years about its doubtful functions in many respects but no serious note has been taken by any authority to look into the matter to check the loopholes of its functioning. This is the organization for recruiting the officers of gazetted posts upon whom the edifice of the administration rests to run the affairs of the State. When any officer is appointed on extraneous considerations, how do we expect such officers to be honest while discharging their duties as a responsible officer hence when base is favoured on corruption the building is bound to come up as most corrupt. Many people had complained earlier that the honesty and fairness is lacking in the Commission and appointments are not being made on the basis of pure merit but people at the helm of affairs have not taken any serious note of such complaints to check the menace.
