India only stakeholder in J&K: BAJ

[ May 01, 2017 ] Impelling the self generated impression that the whole of the legal fraternity in J&K is with separatists and stone-pelters, Jammu & Kashmir High Court Bar Association, Jammu, (JKHCBAJ) convened a Press Conference wherein President, Sh. B.S. Slathia, Sr. Advocate today said that whole of J&K is an integral part of India, the Association always consider India as the only stakeholder in J&K. We, as JKHCBA Jammu, disassociate ourselves from Kashmir Bar’s motivated demand that the Government of India needs to hold talks with separatists to resolve the Kashmir issue, he said. “India is the only stakeholder in J&K, which is politically, legally and constitutionally an integral part of India. Article 1 of the Indian Constitution and Section 3 of the J&K Constitution unambiguously spells out that J&K is an integral part of India and those who are questioning the political / Legal status of J&K vis-à-vis India, are only advocating the pernicious two-nation theory, which no nationalist in J&K would ever endorse. The JKHCBA Jammu makes it loud and clear that it has nothing to do with what the JKHCBA, Srinagar, said in its SLP filed in the Supreme Court. The JKHCBA, Srinagar, stand was a contributed view, which both legally and ethically holds no ground and deserved condemnation from one and all in the Country.,” “People of J&K are stakeholders only as far as the issues of governance and development are concerned,” Sh. B.S. Slathia (Sr. Adv) said and as regards Kashmir’s situation, the JKHCBAJ stands with and for unity of India and its integrity.Slathia welcomed the April 29 Supreme Court’s observation that no talks could be held with those demanding “Azadi” and “separatists” and that there was no problem if the elected representatives in J&K wanted to discuss with the Union Government, the governance and developmental issues.JKHCBA Jammu President also welcomed the Supreme Court’s ruling that if the JKHCBA, Srinagar, gives an undertaking that there will be no stone-pelting in Kashmir, it could consider its demand seeking withdrawal of pellet guns from Kashmir. JKHCBAJ expects Kashmir Bar to rise to the occasion and ensure working with a mindset which is useful in stopping the stone-pelting menace. “The SC’s observation that there could be no talks with those demanding disintegration of India, has sent a right message to Kashmiri separatists and their supporters in the political parties. The Supreme Court has only sanctified the Indian Constitution and Indian sovereignty by rejecting the JKHCBA, Srinagar’s demand. Similarly, by laying down a condition that that there would be no use of pellet guns if there is no stone pelting in Kashmir, the Supreme Court has clinched the whole issue and put the ball in the court of separatists,” said Slathia while welcoming the Supreme Court’s observations and directions. “J&K High Court Bar Association, Jammu represents the nationalist mindset of J&K and therefore feels that Army and Paramilitary forces must be given a freehand to retrieve the situation. India cannot swallow any insult and causalities being inflicted upon our dedicated soldiers and Jawans. It is just unacceptable that the over ground supporters of Pakistan and separatists are allowed any further to target our Jawans. It is high time that this bloodshed is stopped. JKHCBA Jammu also emphasizes that there is a majority in Kashmir which earnestly wants this insanity of Separatists to end for the Schooling of their Children to commence, for the tourism to flourish and for the Kashmir to become a Heaven on earth once again acceptable to the bleeding nation,” said Slathia.discharge its obligation towards the nation and extended the JKHCBA, Jammu’s and legal fraternity’s unflinching support to the armed forces involved in anti-terrorists / anti-separatist operations in the state and other parts of India.
