What needs to be emphasized is that illegal and unauthorized constructions of buildings and other structures not only violate the municipal laws and the concept of planned development of the particular area but also affect various fundamental and constitutional rights of other persons. The common man feels cheated when he finds that those making illegal and unauthorized constructions are supported by the people entrusted with the duty of preparing and executing master plan/development plan/zonal plan. The owners of private land, Parshotam Singh and his brothers sons of Late Amar Singh r/o village Channi Kamala,tehsil Bhau comprising Khasra No. 65 Min measuring 9 Marlas falling in village Channi Kamala, ward-51,Sector-3 on main road of Channi Himmat Housing Board colony filed a civil suit before Special Municipal Mobile Magistrate Jammu in the Court of Sub Registrar Munsiff Jammu on 21-5-2022 for decree of possession of land directing defendants for handling over the vacant possession of the land comprising Khasra No.65 Min measuring 9 Marlas worth Rs 5 crores cost after demolishing the wall raised unauthorized by the defendants situated at village Channi Kmala and got Status Quo order dated 24-5-2022 against Surinder Kumar, Vijay Kumar,Krishan Lal Khem Raj (Defendants) all sons of Late Rama r/o Channi Kamala, Sector-3, Tehsil Bahu District Jammu and for further restraining the defendants from further raising any part thereof and from alienating the same to any other person through themselves or through their agents, assign attorney holder in any matter whatsoever in favour of the plaintiff against the defendants.
However defendants with the help of then Enforcement Inspector Varun Kesar deployed in Ward 51 Channi Himmat area not abiding by Court’s Status Quo order constructed steel fabricator structure on private land under khasra No. 65min on 100% area of the land without maintaining setbacks and without any parking facility with his premises in front of Madan Sweet Shop after firstly constructing fencing and then ramp constructed along with completing plaster work without getting site plan approved from JMC in the last week of Oct 2022.
The owners on 4-11-2022 approached Commissioner JMC and Enforcement Inspector through Whatsapp that despite status Quo granted by Court the defendants have started construction along with pictures of ongoing construction but nothing was done in this regard as Enforcement Inspector did nothing by not reporting serious nature complaint before higher authority of JMC what to think of serving then BOCA notices under relevant sections of BOCA Act 1988 after getting paid handsomely by defendants. Meanwhile construction continued and as a result of which the defendants managed to run washing service station under name and Style, Bankay Car Wash Station by fraudulently managing water and power connections in the month of Feb 2023.
It deserves mentioning here that due to piling of serious nature complaints including allowing unauthorized construction against Enforcement Inspector Varun Kesar including the case in question was transferred 6-3-2022 not before allowing several unauthorized structure in Channi Himmat area. However when owners didn’t get any response from JMC Enforcement Inspector Varun Kesar who completely and deliberately failed to implement Stus Quo and also failed to stop unauthorized construction without JMC permission, they approached Court of Sub Registrar Munsiff Jammu and as a result of which Court served contempt notice to Enforcement Inspector Varun Kesar and Commissioner JMC Jammu asked him to appear before Court on 3-5-2023 to make his stand clear over non-implementation of status quo order. In today’s proceeding, Court ordered Commissioner JMC AND Enforcement Inspector to come ready with explanations over unauthorized constructions and failure of JMC to maintain Court’s Status Quo order.The next date of hearing has been fixed on 18-5-2023. It cannot be denied that Municipal areas have seen an unplanned growth and the menace of illegal and unauthorized construction and encroachments have acquired monstrous proportions and everyone has been paying a heavy price for the same. In fact, it is on account of encroachments made on the road, there are frequent traffic congestion affecting the heath of the road-users.

- JMC yet again makes mockery of notice under section 253 (1) JMC Act 2000 served to owner of residential plot 66/5 ,Ward-50 Channi Himmat wherein serves 48 hours ultimatum to owner to remove violations dated 14-10-2024 but without taking follow-up action against owner approves fresh site plan dated 28-11-2024 when existing violations were not removed by owner after giving written undertaking and further construction of two floors started
- JMC Building Section out of way sanctions stilt floor commercial parking stage-1st at commercial sites 3,4 and 5 in Sector-2 Ward-50 Channi Himmat and enforcement staff fails to take action against owners when differently approved site plans clubbed and raised joint construction of commercial halls as single unit without maintaining setbacks and not constructing new stilt floors commercial and in spite of violations in stage-1st construction JMC approved stage 2nd construction and at present stage-2nd construction going on from last 15 days with help of enforcement staff
