Jammu Municipal Corporation has totally failed to curve illegal and unauthorized constructions of buildings and other structures which not only violate the Municipal laws and the concept of planned development of the particular area but also affect various fundamental and constitutional rights of other persons. The common man feels cheated when he finds that those making illegal and unauthorized constructions are supported by the people entrusted with the duty of preparing and executing master plan / development plan/zonal plan especially Enforcement Inspectors.To quote another instance of dereliction of duty on part of Enforcement Inspectors, one Mohinder Singh purchased a Housing Board residential plot 542/3 Channi Himmat Jammu measuring 52 ½ x 51 (2700 Sqft) from original alottee Radha Krishan. It deserves mentioning here that the owner without getting site plan approved from JMC/ Housing Board initially constructed four small sized shops front side main road on residential plot keeping a good portion of residential plot as vacant from backside and thus making land use change. However when locals strongly protested commercial construction on residential plot, Housing Board under huge pressure of law abiding citizens taking serious cognizance of violations in question and also other serious nature violations of land use change served a notice to alottees of Housing Board Colony dated 9-1-2020 for sheer breach of lease deeds saying that the land shall be used solely and exclusively for the purpose for which it has been leased out and for no other purpose and the lessee shall erect thereon building according to the plan and elevation approved by Housing Board within three years from the date of execution of deed. This notice was served to nearly 197 violators in Sector-1 to Sector-7 Channi Himmat Housing Board Colony for sheer breach of lease deed and Mohinder Singh name in this list was at serial No.99.It deserves mentioning here that similar notice was also served by JMC dated 4-1-2020 having same language of sheer breach of lease deed. The owner is still facing trial against these notices by Housing Board and JMC.
Worthwhile to mention here that now owner with the help of then Enforcement Inspector Varun Kesar and now Jasbir Singh has started construction of big shops existing its area of existing shops from backside using hundred percent area covering almost total area which was earlier kept vacant from backside without getting permission from JMC and at present the violated construction making land use change from residential to commercial is heading towards finishing level with the help of Enforcement Inspector Jasbir Singh which means that question does not arise to serve owner BOCA notice as the Enforcement Inspector Jasbir Singh who was duty bound to submit violations report that owner extending size of existing shops by covering hundred percent area from backside was infect helping and supporting owner to raise big four shops covering hundred percent area without maintaining setbacks and after visiting site one can easily say that it is a big restaurant under name and Style Atiha multicusine Restaurant. It is unfortunate to note that despite bringing violations in the kind notice of enforcement Inspectors timely and properly nothing has been done in this regard which should be taken seriously by Commissioner JMC and also Mayor who recently publically admitted that Enforcement staff is not doing its duty honestly and bringing bad name to JMC. One thing is sure unless enforcement staff extending unfair patronage to violators is not suitably punished, the ground situation of huge violations will not change at all. It cannot be denied that Municipal areas have seen an unplanned growth and the menace of illegal and unauthorized construction and encroachments have acquired monstrous proportions and everyone has been paying a heavy price for the same. In fact, it is on account of encroachments made on the road, there are frequent traffic congestion affecting the heath of the road users.

- JMC yet again makes mockery of notice under section 253 (1) JMC Act 2000 served to owner of residential plot 66/5 ,Ward-50 Channi Himmat wherein serves 48 hours ultimatum to owner to remove violations dated 14-10-2024 but without taking follow-up action against owner approves fresh site plan dated 28-11-2024 when existing violations were not removed by owner after giving written undertaking and further construction of two floors started
- JMC Building Section out of way sanctions stilt floor commercial parking stage-1st at commercial sites 3,4 and 5 in Sector-2 Ward-50 Channi Himmat and enforcement staff fails to take action against owners when differently approved site plans clubbed and raised joint construction of commercial halls as single unit without maintaining setbacks and not constructing new stilt floors commercial and in spite of violations in stage-1st construction JMC approved stage 2nd construction and at present stage-2nd construction going on from last 15 days with help of enforcement staff

- Existing violated structure on private land falling under Khasra No. 4 Min, Ward-51, Channi Himmat earlier sealed, site plan withdrawn, then restored without removing violations now undergoing complete renovation and conversion from sanctioned mixed use of both residential and commercial to full-fledged commercial halls on three floors measuring 10000 sqft each to run big size shopping mall without JMC permission but with help of enforcement staff deployed in Channi Himmat
