Owner in her sale deed dated 26-3-2018 has mentioned that bifurcated portions which she purchased had got collapsed due to heavy rain and subsequently demolished by owner Ramesh Kumari from whom she purchased and now there is an open plot along with a compound wall existing on spot. But surprisingly when JMC served BOCA notice to owner, she claimed that she is undertaking repairing work of her existing residential structure which only means that she is big liar as if the existing structure collapsed in 2018 what she was repairing which has been aptly proved by her that she has undertaken altogether fresh construction
Without NOC from J&K Housing Board and JMC permission, owner undertook fresh construction by completely dismantling existing residential construction with help of JMC enforcement staff against guidelines of JMP-2032 and Building Bye-laws 2021
When locals protested violative construction, the owner moved an application to JMC dated 12-10-2022 claiming that she is undertaking repair work without any roof replacement but owner was undertaking altogether fresh construction with new walls, windows and roofs, steel beaming and steel framing on ground and first floor and it was not at all any repairing work as was claimed by owner to hoodwink JMC
Owner wrongly moved an application to JMC dated 12-10-2022 claiming that she is undertaking repair work as the house she resides in is old one and has developed cracks and that permission be provided to her to repair the same without any roof replacement so that the structure can withstand seismic vulnerability whereas in reality undertook altogether fresh construction
Owner also lied before Tribunal that her immediate neighbors have already given NOC to her for renovation/altercation work when there was no such works but fresh construction and infect her neighbours were the one who strongly protested against this construction and even registered complaints before Commissioner JMC

- JMC yet again makes mockery of notice under section 253 (1) JMC Act 2000 served to owner of residential plot 66/5 ,Ward-50 Channi Himmat wherein serves 48 hours ultimatum to owner to remove violations dated 14-10-2024 but without taking follow-up action against owner approves fresh site plan dated 28-11-2024 when existing violations were not removed by owner after giving written undertaking and further construction of two floors started
