Unauthorized commercial construction is going on at private land in Sector-4 of old village Channi Himmat wherein at present unauthorized construction of 2nd floor on already existing commercial shops going on without JMC permission and without maintaining setbacks covering nearly 1500 Sqft area

There is no dearth of rules, by-laws, and statutory provisions that govern the conduct of construction activities in Municipal areas under jurisdiction of JMC. However, illegal construction continues to thrive. While such activities are nearly universal across all areas, they are most rampant in Municipal areas. A primary reason is that in these large cities, the cost of land is steep and the huge demands for housing, office and commercial space far outstrip planning speed, product supply, and spatial availability at affordable rates. Urbanization in recent years has triggered unbridled construction activities to meet the needs of the growing populations in Municipal areas. Not all of these constructions abide by existing laws, however, leading to adverse consequences on governance systems, the environment, people’s health, transportation services, and overall citizen well-being besides no parking facility available for land use change cases causing massive traffic jams every now and then.. To put the things in perspective, various unauthorized constructions are going on in Channi Himmat Housing Board colony with the help of enforcement section of JMC particularly with active support of Enforcement Inspector Ram Khajuria. In he latest , the unauthorized construction is going on from Nov 2023 at residential plot No. 150/3, measuring 30×55 Sqft Channi Himmat Jammu owned by Rashpal Singh as per Housing Board record. It deserves mentioning here that the owner has raised two bed room set on main road side of colony without getting site plan approved from JMC and without maintaining setbacks covering nearly 1000 Sqft. RTI application filed in this regard dated 7-12-2023 when the unauthorized construction was going on, Senior town planner replied that no site plan has been approved in favour of owner of residential plot 150/3 vide No. JMC/BS/RTI/371-74 dated 8-1-2024 whereas construction is going on from the last three months. Similarly another unauthorized construction is going from Nov 2023 at corner residential plot 45/3 measuring 30×55 Sqft Channi Himmat Housing Board colony owned by one Mahesh Kumar Sharma construction of first floor is going on already existing unauthorized ground floor without JMC permission and also without maintaining setbacks covering nearly 1600 Sqft. It deserves mentioning here that the owner is already facing BOCA notice and even then started construction of first floor with the help of enforcement Inspector Ram Khajuria. When an RTI application filed in this regard dated 23-11-2023, Secretary JMC who is also incharge BOCA Authority in Channi Himmat area replied that the construction is stopped but didn’t provide supportive documents to ascertain her action. Likewise another unauthorized construction is going on at private land in Sector-4 of old village Channi Himmat near Jai Hind Bakery Housing Board colony Channi Himmat Jammu adjoining with plot No.418/7 also falls in Sector-4 Channi Himmat Housing Board colony wherein at present unauthorized construction from Dec is going on at 2nd floor on already existing commercial shops without JMC permission and without maintaining setbacks covering nearly 1500 Sqft area and also making serious nature altercation in whole of existing commercial structure. In addition to this many more unauthorized constructions are going on in various parts of Municipal areas against JMP-2032 and Unified Building Bye-laws 2021 with the help of enforcement staff which instead of taking action against violators rather extending all possible help to them in lieu of illegal gratification which has resulted in boom in unauthorized constructions.

- Nepotism and favoritism at its best in PHE Division Akhnoor in case of Kamini Kumar at present working Head Assistant at PHE Division Nowshera has wrongly drawn his salary/leave salary from 2011 to 2024 and has served in PHE Division Akhnoor w.e.f. 1988 to 2024 as daily wager, class ivth, Junior Assistant, Senior Assistant and not served anywhere except his present place of posting in Nowshera PHE Division despite his transfers with promotions
- JMC continues to act as mute spectator, violators raising choice construction with help of enforcement staff against JMP-2032, UBBL-2021, JMC Act 2000
- JMC fails to implement verdict of High Court Jammu dated 9-10-2024 in case of residential house 584/4, Ward-50 Channi Himmat by allowing owner to continue running big shop under name & Style Durga Dutt Mart after converting drawing room making land use change from residential to commercial when JMC was at liberty to proceed against owner in case he doesn’t restore back drawing room by closing shop on residential ground floor and use premises purely for residential purpose only and de-seals shop when owner doesn’t fulfills conditions of de-sealing order
- JMC fails to serve notices under JMC Act 2000 to owner of residential plot 629/3, Channi Himmat for raising three floors commercial structure without maintaining setbacks , changing both internal and external dimensions after getting residential site plan approved from JMC but not raising residential construction except keeping space for temporary windows and keeping two way entry completely deviating from approved site plan contrary to JMP-2032,UBBL-2021, JMC Act 2000
