When Enforcement Inspector Gagan Kumar deputed in Ward 50 and Ward-51 called on Mobile on 22-3-2024 afternoon about action taken, he categorically denied that he has not visited Channi Himmat so far as he hasn’t joined as Enforcement Inspector Ward-50 and Ward -51 which speaks volumes how serious they are in taking action against violators on complaints of aggrieved people in the area
JMC instead of taking action against its Enforcement staff for supporting violators after several complaints against them for not taking action against violators, the best JMC did is transfer of Enforcement Inspector from one ward to another but they are never ever held accountable for the unauthorized constructions raised during their tenure in their respective wards after transfer from one ward to another

Notwithstanding creating special wing in JMC and deputing charge of Enforcement Wing of JMC to a Joint Commissioner (R&E) level officer, Dy Commissioner (South), Dy Commissioner (North) deputing good number of Enforcement Officers, Enforcement staff particularly Enforcement Inspectors in all 75 Wards unauthorized constructions in Channi Himmat, Gandhi Nagar, Shastri Nagar Govt Housing Board colonies going on unabated as Enforcement staff extending all possible help to violators to raise choice constructions even against approved site plans and against guidelines of Jammu Master Plan 2032 and Unified Building Bye-laws 2021 resulting in unplanned housing colonies and resulting in unnecessary sufferings to law abiding citizens of the area.
To put the things in perspective, one Vishav Deepak owner of residential Govt plot 250-C, Sector-2, measuring 25 x54+ 65/2 (1487 Sqft) on main road of Channi Himmat Housing Board colony adjoining with Govt Middle School Channi Himmat and also old settlements backside of this plot has started commercial construction on RCC Pillars without getting site plan approved from JMC without maintaining mandatory setbacks. It deserves mentioning here that Vishav Deepak Suri purchased this plot from Chander Bhushan costing worth crores and the same got registered in Court of law dated 29-6-2022 and the aim of purchasing plot was very much clear to raise commercial construction which became a reality after taking our possession and commercial construction started at site.

Worthwhile to mention here that Incharge Enforcement Officer Anil Kashyap and Enforcement Inspector Gagan Kumar deputed in Channi Himmat area yesterday visited Channi Himmat area after several complaints were lodged along with pictures that several unauthorized commericial constructions going on in the area in Ward-50 and Ward-51 but this enforcement team went back without taking action against violators and this visit mere proved picnic for them and also encouragement to violators to carry on with these unauthorized constructions. The visiting team didn’t take action against unauthorized shopping complex construction at 32/3 going on without approved site plan private land double story Shopping complex owned by one Viraaj in Channi Himmat Housing Board colony opposite Kalyag Jwellers Main Road sector -3. Notwithstanding huge unauthorized construction against approved site plans going on unabated in Channi Himmat Govt planned Housing Colony resulting in serious violations of Master Plan 2032 and Unified Building Bye-laws 2021,JMC enforcement staff has been offering tutor services to violators how to raise unauthorized constructions and how to retain it if any relevant notices against unauthorized constructions are issued against them. In other words, the action against violators for raising construction against guidelines of JMP-2032 in the form of serving notices under section 253,254 of J&K Municipal Corporation Act 2000 have so far turned mere cosmetic exercise as in most of the cases no follow-up was taken resulting in unabated unauthorized constructions in Channi Himmat area.

- JMC fails to implement verdict of High Court Jammu dated 9-10-2024 in case of residential house 584/4, Ward-50 Channi Himmat by allowing owner to continue running big shop under name & Style Durga Dutt Mart after converting drawing room making land use change from residential to commercial when JMC was at liberty to proceed against owner in case he doesn’t restore back drawing room by closing shop on residential ground floor and use premises purely for residential purpose only and de-seals shop when owner doesn’t fulfills conditions of de-sealing order
