Public of Jammu city is facing dominant phase of Inspector Raaj because of no control on Enforcement wing of JMC by higher administration of JMC. Completely Jungle Raaj is going on in Jammu Municipal Corporation Enforcement wing which works under the overall control of Sh. Rakesh Kumar, Joint Commissioner (Revenue & Enforcement). Below JC(R&E) there are 02 Deputy commissioners (North & South). These 03 posts were created in the recent Reorganization Order No 64-JK(HUD) of 2022 dated: 12.05.2022 but there is no effect on controlling the illegal building constructions in the city. Illegal constructions through bribe with unholy nexus of Enforcement wing is going on every nook and corner of the city. Public money on the expenditure as salary of these 03 newly created posts is merely the wastage of public money. There is no control, monitoring or change visible in respect of illegal building constructions, enforcement activities in the city anywhere. Even the quantum of illegal constructions is increased now more than the previous months/years. The only visible effect is the increase in the bribery rates of the enforcement wing. Neither Joint Commissioner (R&E) nor DC(North) or DC(South) visits frequently for field inspections to check illegal constructions. Even In-charge CRO/CEO or EO don’t visit their allotted wards and depends or rely upon the false reporting and stories of their corrupt, unqualified and incompetent enforcement inspectors, senior assistants and junior assistants. The officers sit in their AC rooms and enjoy leisure of Govt. facilities at the cost of public money. Enforcement wing of JMC only perform their so called legitimate duties on the complaints of encroachments by general public. Many times because of the illegal constructions and encroachments the inhabitants and the neighbors starts fighting with each other because of the encroachments of lanes/drains etc which ultimately leads to law and order situation. This all happens because of the enforcement wing involvement with the encroachers, they always share the name and contact details of the complainant to the encroacher, and then the quarrel begins. Enforcement wing does this just because of bribe they receive from encroacher or the defaulter. These entire problems happen because of the biased and irrelevant deployment orders issued by JMC administration from time to time. One of the latest such enforcement wing deployment order issued vide No. JMC/Estt/14387-93 dated: 15.03.2024 is the glaring example of such blunders, which happened in the past also. In the said order, Junior assistants and senior assistants were deployed for enforcement of illegal constructions in different wards. They are merely clerical staff and doesn’t have any technical knowledge and even doesn’t know any building constructions rules and regulations. Many of them are not even graduate and don’t have the competence to understand Building Bye laws, structure strength, Master Plan and other statutory rules to be followed while constructing a building. These clerical staff is just competent in gathering bribe and allowing illegal constructions. The enormous ongoing illegal constructions in Jammu City itself speak about their incompetence and their bribery role in ongoing illegal constructions. It is not only their fault but also the fault of the higher administration of JMC who deployed junior assistants and senior assistants for field job for which they are not at all entitled or eligible. In the said order, one Mr. Pranav Jamwal, Junior Assistant is given the duties as enforcement inspector for 07 wards. His record in his previous wards posting is very poor and he allowed rampant illegal constructions in his previous wards but still given 07 wards in the recent order. He is just a Junior assistant and even not graduate then how he is allowed and deployed as Enforcement inspector in 07 wards is the biggest question arises on the intentions of the administration of JMC. Another example is Sh. Ashwani Kumar, who is also a junior Assistant who is not even able to write his casual leave at his own but deployed as Enforcement inspector to enforce master plan and building byelaws. These clerical staff even does not know the meaning of Master Plan and Building Bye Laws then how JMC administration expected from them that they will enforce the statutory laws. This is just the mockery of rules and regulations by JMC administration. JMC Order No. JMC/Estt/14387-93 dated: 15.03.2024 is completely bizarre and weird. In the said order, Sh. Sunil Gupta who is basically a Food Safety Officer and is working as I/C Revenue Officer is now deputed as I/C Chief Revenue Officer. What rules, regulation and logic have been followed while deploying a FSO as I/C CRO can only be known to the administration of JMC. Sh. Kuldeep Kumar is deputed as “L/A EO” and what that means can also only be known to JMC administration and these type of designations and abbreviations exists in the orders of JMC only. JMC administration always write in their enforcement officials deployment orders that they will conduct extensive checking of illegal constructions in their allotted wards and make registers of ongoing constructions in their wards. They will take action against the violators and inform their superior officers accordingly. But the question arises “where are those registers ?” in which the illegal/legal constructions details were maintained. JMC administration itself failed to implement their orders in letter and spirit. These orders are just eye wash for the public and the higher authorities of J&K Government. Thousands of illegal building constructions are going on in the entire Jammu city with the nexus of Enforcement inspectors of JMC but Commissioner & Joint Commissioner (R&E) failed to take any stringent action against the enforcement wing. In the public interest and to implement rule of law it is most humbly requested to Hon’ble LG of J&K and Chief Secretary, J&K to personally intervene and give directions to Commission Secretary of Housing & Urban Development Department to take action against these erring officers/officials of JMC and take action against the administration of JMC for failing to perform their legitimate duties and save general public from this “Inspector Raaj” arbitrarily imposed by Jammu Municipal Corporation.
