The ongoing construction of tin shed was duly brought into kind notice of Enforcement Inspector deputed in area Gagan Kumar by aggrieved locals but instead of taking action against owner, he lied that the work is stopped but the shed work is going on as on date. This is now a well established modus operandi that initially raise tin shed get the walls white washed simultaneously and later using modern techniques available in market turn it into impressive first floor and the same will be done in the present case also
Despite well defined powers designated to enforcement staff, they have been found more inclined towards violators failing to perform their designated duties. In the present case of construction of tin shed under the garb of Coca Cola hoarding is completely illegal as such hoardings are strictly prohibited in residential areas and even on roof tops of commercial site unless designated sites by JMC as per JMC advertisement policy 2010

JMC enforcement staff now days has come out with new modus operandi to allow unauthorized construction under the wrap of big hoardings in Channi Himmat Housing Board Zonal Planned colony in lieu of illegal gratification without approval of site plans from JMC. The live example of this ongoing tin shed construction on first floor of eatery point under name and style Punjabi Brothers Surankote Wale on already violated construction of two shops on ground floor measuring more than 600 Sqft , village Channi Kamala, Sector-3 on main road of Channi Himmat Housing Board colony from last one week without JMC permission.

There is denying to the fact that marked value of land in Channi Himmat area over the last few years has gone extremely high reaching worth many crores which has resulted in rise in violated construction particularly commercial construction in active connivance with JMC enforcement staff deputed in respective areas. The enforcement staff has made ample use of higher prices of land by charging from violators at their sweet will at the cost of JMP-2032 and Unified Building Bye-laws 2021 in contravention of zoning regulation and damaging planned development of Jammu city.
The campaign launched by the Jammu Municipal Corporation (JMC) against illegal construction and commercialization of residential areas in the city has turned out to be a sham as a “go slow” policy has been adopted by the Corporation taking action on pick and choose basis offering patronage to influential violators and taking harsh action on those having no such access at administrative and political level.
Sources said due to the pressure from people having close political connections the illegal transformation is going on with impunity while the enforcement agencies are turning a blind eye towards the unlawful activities. Despite law passed against such violations, civic body in Jammu has failed to stop conversion of residential colonies into commercial spaces, which has led to chaos in many areas in the urban centres. Law says that for converting any category of land and building into a commercial one, proper permission has to be taken from the competent authority as defined in revenue laws, but in the city most of the people are violating the set rules.
