Despite the High Court directions not to allow coaching centers without adequate facilities, dozens of tuition centers are being run in Jammu city and even some from residential houses with authorities just overlooking to take action. The constitution of various committees to ensure maximum registration of private coaching/tuition centres in Jammu has failed to yield the desired outcome. The Supreme Court of India has held that Coaching centres must shift out to commercial premises or institutional areas and should not be permitted them in residential areas . Most of the coaching centres are functioning in violation of this rule. They have become a source of sound pollution and other civic problems.
To put the things in perspective, one such coaching centre under name and style Credible Institute of Learning, foundation NEET, JE 9th class to 12th class is being run from residential house 600/3 measuring 30×55 Sqft , Ward-50 Channi Himmat Housing Board colony without parking facility having three stories owned by one Amit Sharma who happens to be Chemistry teacher. As per Housing Board record residential plot 600/3 stands registered in name of original alotee Vinod Kumar s/o Chaman Lal r/o 139 opposite Dak Banglow Jammu.
Now the owner after running Institute without permission and registration in Directorate of School Education Department now from the last one week has started construction of 4th floor measuring nearly 1300 Sqft at par with existing three floors size with brick walls but for the time being put tin shed with windows and ventilators towards front and backside without JMC permission which is not at all allowed as per JMP-2032 and Unified Building Bye-laws 2021. The owner has already put another sign Board which reads Root Tuition Centre for strong foundation for classes 10th to 12th on 4th floor
It deserves mentioning here that then Managing Director, J&K Housing Board, Jammu had provided a list of alotees in Channi Himmat Housing Board Zonal Planned colony to Commissioner JMC vide No. HB/961-64 dated 19-6-2020 who have converted their residential premises into commercial units in sheer breach of lease deed conditions with the request to initiate action against such defaulters under BOCA Act 1988. In that list residential plot 600/3 displays at serial No.103 for running credible institute having three stories from residential plot.
Accordingly JMC served public notice to nearly 227 alotees of Housing Board plot for making land use change from residential to commercial in Channi Himmat Housing Board colony spreading over Sector-1 to Sector-7 and the same was widely published in print media under DIP/J-4188-P dated 9-1-2020 and residential plot 600/3 was also mentioned in list of defaulters. Pertinent to mention here that prior to publishing of list of defaulters for making land use change from residential to commercial, the Housing Board had also published same list of defaulters. But JMC didn’t take any follow-up action after serving alotees notice when all the defaulters were supposed to reply to this notice within one month failing which there was possibility of lease deed being cancelled.
Surprisingly the owner of 600/3 while replying to this notice made a bizarre claim that he and his wife run Cafereria at Bahu Plaza for the sake of their livelihood and in the evening he and his wife offer tuition to unprivileged students and don’t charge them and that he is not running any coaching centre and so is not running any commercial activity from his residential house. As per the reliable sources, the owner being a Chemistry teacher running full-fledged institute under name and style Credible Institute of Learning, foundation NEET, JE 9th class to 12th in Channi Himmat area.
The owner lied and somehow managed to continue running tuition centre which is still continuing from his residential house . Worthwhile to mention here that there is not even a single Institution which offers free coaching for NEET and JE Mains including institution in question. Now with construction of 4th floor without JMC permission, the owner has crossed limit of violation as such a violation is strictly prohibited as per JMP-2032 and Unified Building Bye-laws 2021.

- JMC yet again makes mockery of notice under section 253 (1) JMC Act 2000 served to owner of residential plot 66/5 ,Ward-50 Channi Himmat wherein serves 48 hours ultimatum to owner to remove violations dated 14-10-2024 but without taking follow-up action against owner approves fresh site plan dated 28-11-2024 when existing violations were not removed by owner after giving written undertaking and further construction of two floors started
