When an RTI application filed dated 13-6-2024 in this regard to seek information whether any BOCA notices served to owner for raising construction of two stories shop and whether owner has obtained land use change certificate from JDA, the Enforcement Officer Kuldeep Kumar who is also CPIO replied dated 13-8-2024 vide letter No. JMC/Enf /188-90 dated 29-7-2024that no commercial activity is going on at the site which was a white lie as even layman visiting site can tell easily that ongoing construction is purely two stories shop and in no way any residential construction that too without parking facility and also without maintaining setbacks and last but not the least without seeking permission from JMC
Beyond any doubt that enforcement staff is heavily inclined towards violators and also this is the reason that construction is going on since April 2024 onwards but so far no BOCA notices served to owner and openly and brazenly allowing construction of two stories shop against JMP-2032 and Unified Building Bye-laws 2021 without getting land use change certificate from JDA

Jammu Municipal Corporation and other concerned Government agencies have allowed whole of the Housing Colony of Gandhi Nagar, which otherwise is a residential area, to be converted into commercial area by giving permission for opening of big shopping complexes, nursing homes, restaurants etc. As per the information collected by invoking the provisions of J&K Right to Information Act, 2009, Housing Colony of Gandhi Nagar was developed by J&K Housing Board for residential purposes and as per the records available no commercial building permissions have been accorded in Housing Colony Gandhi Nagar other than the area earmarked for commercial activity by the Housing Board.
In continuation of the same, one Harnam Singh original alottee of residential plot 496-A measuring 45×65 Sqft on Laxmi Narayan Temple road in Gandhi Nagar Housing Board Zonal planned colony is undergoing construction of big two stories commercial shop from April 2024 onwards with the help of Enforcement staff deputed in area without getting site plan approved from JMC and without maintaining mandatory setbacks and now flooring is being done at the site. Due to this callous attitude of JMC and other concerned departments, Gandhi Nagar has acquired the status of more of a commercial hub having big shopping centres of every type including sale and service of motor vehicles than remaining a Housing Colony and commercial activities start from famous Green Belt area covering all the main arteries and sub-lanes of this posh colony. The violators of the law were hand in glove with the law enforcing agencies of the then Jammu Municipality and now with the officials of substituted Jammu Municipal Corporation. In the earmarked residential zones, nursing homes, restaurants, insurance offices, banks, gyms and beauty salons etc. have come up with full immunity During festivals as well as sale period whole of Gandhi Nagar Housing Colony is blocked by traffic jams as such it causes inconvenience to the local residents and other users. Some big houses have even got their own water supplies by underground drillings with the connivance of Public Health Engineering Department. The astonishing aspect is that Power Development and Public Health Engineering Departments have also provided electricity and water connections to these commercial houses, which are also causing pollution in residential areas detrimental to the health of the residents. Moreover, they have also allowed the use of heavy generators which emit noise and carbon-dioxide at high rate. The concerned departments including JMC should take serious cognizance of this and immediately gear-up men and machinery to stop commercial constructions from residential houses.

- JMC yet again makes mockery of notice under section 253 (1) JMC Act 2000 served to owner of residential plot 66/5 ,Ward-50 Channi Himmat wherein serves 48 hours ultimatum to owner to remove violations dated 14-10-2024 but without taking follow-up action against owner approves fresh site plan dated 28-11-2024 when existing violations were not removed by owner after giving written undertaking and further construction of two floors started
