One Ramesh Chander s/o Nagar Mal c/o M/S Ramesh Enterprises Jammu owner of residential plot 152/7 measuring 40X80 (3200 Sqft) Channi Himmat Housing Board colony constructed a violated floor measuring nearly 2200 Sqft along with porch measuring 200 Sqft and use it as AK Studio. However owner applied for further construction of ground and first floor vide application No. 2745 dated 25-8-2022. As per Building officer report existing ground floor already approved by JMC and a shed is existing at rear setback of site which owner intends to demolish as per submitted drawing. However proposal of residential construction conform to norms of UBBL 2021. As desired, previous case NOCs data uploaded in which in which Board received in the instant case. Lane along the site is 18 mtrs. Site is a part of Channi Himmat Housing Board colony. JMC approved site plan despite violations of setbacks vide No. 1941/JMC/BS/2022 dated 6-2-2023 allowing first and 2nd floor 130.27 Sqm (1402 Sqft) each with front 6.71 mtr (22 ft) , rear 3.05 mtr (11.5 ft) and side-1 3.05 mtr. The owner was not allowed construction on existing porch and allowed terrace on both floors. The height of building fixed 11.34 mtr (37 ft) from front road level and accordingly paid permitted area fee Rs 12610 and also gave undertaking on affidavit that he will demolish violative portion of existing ground floor as per approved site plan raised at the site before start of fresh construction vide No. INJK05977869818294V dated 16-1-2023. But the owner with help of then enforcement staff didn’t demolish violative construction (11.5 ft x 40 ft) from backside . With the help of enforcement staff, the owner raised two equal floors ( full-fledged commercial hall without walls partition 2200 Sqft each against permitted 1402 Sqft each without maintaining mandatory setbacks in the month of July 2023. This dual functioning of enforcement staff one for rich and another for poor has been strongly resented by aggrieved locals as in most of cases enforcement staff spares action against rich and influential violators but remains ready to target poor with minor violations and the same is highlighted in social media as if they are very strict against violative construction but the reality is that they always join hands with influential violators and never report serious violations at initial stage and also until, and unless print media highlights such violative construction. Commissioner JMC is once again urged to punish enforcement staff who are openly allowing coimmercial coinstruction on residential plots against JMP-2032 and Unified Building Bye-laws 2021.

- JMC fails to implement verdict of High Court Jammu dated 9-10-2024 in case of residential house 584/4, Ward-50 Channi Himmat by allowing owner to continue running big shop under name & Style Durga Dutt Mart after converting drawing room making land use change from residential to commercial when JMC was at liberty to proceed against owner in case he doesn’t restore back drawing room by closing shop on residential ground floor and use premises purely for residential purpose only and de-seals shop when owner doesn’t fulfills conditions of de-sealing order

- JMC’s BOCA notices and undertakings by owners fail to stop unauthorized constructions in absence of their implementation on ground as witnessed on residential plot 203/2 on main road side Channi Himmat Ward-50 where JMC after serving BOCA notice to owner didn’t take any action after owner submitted undertaking resulting in running of RK Fabrics earlier from shop of residential ground floor now from whole of ground floor residential making land use change and raising first floor without JMC permission without maintaining setbacks
