Now JMC under extreme public pressure has finally served owner demolition notice under Section 253 (1) of JMC Act 2000 wide No.JMC/DC (S)/Enf/322-26 dated 25-11-2024 serving owner seven days ultimatum to remove violations from the receipt of this notice failing which same shall be demolished by JMC at the cost and risk of owner. Reliable sources have confirmed that the owner against JMC demolition notice has approached J&K Special Tribunal Jammu Bench-III on 2-12-2024 and got status Quo

Makeshift shops/Jhuggis/Kiosks growth has seen huge mushrooming in recent time within Municipal areas and the concerned agencies have so far proved mute spectators especially in Wards-51 and 52 of Channi Himmat Zonal planned colony, Channi Bija, Trikuta Nagar Extension notwithstanding the fact that these unauthorized Makeshift shops/Jhuggis/Kiosks have always remained serious security issue besides den of illegal water and power connections and last but not the least is traffic congestion as wherever these Makeshift shops/Jhuggis/Kiosks have been established there is absolutely no parking facility and results in hug and long traffic jams.
To quote few instances, already in Ward-51 and Ward-52 well known and popular by name, “Bagar Market” without JMC permission has been established for last ten years wherein hundreds of shops using tin, wood or any fabricator structure have been established running different businesses and God-forbidding if any fire incidents takes place as has already been witnessed in similar establishments elsewhere in Municipal areas , one can’t imagine what it will cause to law abiding citizens whose peace has been shattered with the establishment of such markets. Similar markets have been also established in Channi Himmat, Trikuta Nagar extension (Channi Bija), Parveen Chowk and the concerned enforcement agencies as on date sparing action against them to fulfill their vested interests.
It deserves mentioning here that inspired by already establishment such Makeshift shops/Jhuggis/Kiosks in nearby areas, one Satish Kumar Jamwal r/o Tikuta Nagar extension near Bikaner Sweets shop owner of nearly 4.5 Kanals has been constructing fabricator tin sheds nearly 100 in number from the last six months covering nearly half of area in his ossession. JMC didn’t take any action against owner when construction of these Makeshift shops/Jhuggis/Kiosks was going on and woke up from deep slumber when these structures complete in all respect were handed over to all those who intended to run their businesses who started their businesses after being sublet by owner. Worthwhile to mention here that when locals strongly resented construction of such fabricator structures from business point of view anticipating security risks and unnecessary noise pollution putting in danger right to freedom and right to peace of law abiding citizens , JMC in an eyewash action served owner initial stage notice vide No.JMC/DC( S)/Enf/275-78 dated 7-11-2024 for construction of tin sheds without any valid permission from JMC and without following norms and observing setbacks as per UBBL-2021/Master Plan-2032 but the owner didn’t reply to this notice when said illegal construction seriously affects the planned development of Jammu city and contravenes the zoning regulation.

This is a serious issue which deserves urgent attention of JMC Commissioner to stop Zonal Planned colony Channi Himmat Housing Colony from becoming commercial hub like Gandhi Nagar and Shastri Nagar. JMC Commissioner should take serious cognizance of construction of illegal kiosks and should instruct the Khilafarzi wing for dismantling unauthorized kiosks in Wards 51 and 52 Channi Himmat Housing Board colony, Trikuta Nagar extension(Channi Bija) . Moreover, shielding willful violators of illegal constructions should be seriously taken by JMC higher authorities. The way demolition notice served to Satish Kumar Jamwal, three others running similar markets in ward 51 and 52 should meet the same fate as these unauthorized markets are serious security threats and also causing traffic jams without any parking facility . There is an urgent need to break already established nexus between JMC enforcement staff and owners who are earning in lacs monthly earning nearly Rs 3000 to Rs 5000 daily without taking into consideration the hardships law abiding citizens face.
