JDA further claims that Fruit Mandi Complex Narwal, Jammu has been transferred to Horticulture Planning and Marketing Department vide J&K Govt order No. 348/Agri/Horti/P&M/2008 dated 12-12-2008 when it was asked to provide information whether JDA from 2-12-2021 to onwards approving site plans since when UBBL-2021 came into being as per UBBL-2021as if they have no concern with ongoing constructions in Fruit Mandi Complex Narwal after transfer of area to Horticulture Department
If as per JDA it has been approving site plans as per UBBL-2021 since its approval from Board of Directors of JDA in the meeting held on 1-12-2021, then as per UBBL-2021 100% coverage can’t be provided without asking owners to maintain setbacks as owners under UBBL-2021 only entitled to 50% construction area for plots falling under slab 300 Sqm to 750 sqm as has been done in case of Vimla Rani wife of Lt Raj Kumar r/o Trikuta Nagar Jammu owner of commercial site-5 measuring 90×50 (4500 sqft) at Fruit Mandi Complex Narwal , Phae-II, Ward-49 vide application No. JMC/2023/5070 dated 27-5-2024 allowing owner hundred percent plot area under construction measuring nearly 418.19 sqm(4500 Sqft) without asking owner to observe setbacks allowing owner new Basement-1 commercial measuring 418.19 sqm, new ground floor commercial measuring 418.19 sqm(4500 sqft)
JDA itself admitting that Fruit Mandi Complex Narwal area falls under jurisdiction of JMC, then how come JMC claiming that issues permission in these types of schemes as per coverage confirmation given by JDA with respect to lease agreement and JK UBBL-2021 does not implement in these plots which are part of a scheme with separate parking lot provisions as per JDA in a way both JMC and JDA disowning responsibility to say how owner can be granted 100% coverage without asking owner to maintain setbacks when JMC admits UBBL doesn’t apply at Fruit Mandi Complex Narwal and JDA claiming that it approves every site plan as per UBBL-2021 since it came into being as Fruit Mandi Complex Narwal area falls under JDA jurisdiction.

Golden Yug daily English Newspaper published a story dated 8-2-2025 titled, “JMC approves commercial site plan allowing owner to cover 100% plot area in construction of commercial basement for storage & utility and commercial ground floor without mentioning their height not mandating to maintain setbacks at JDA’s commercial site No.5 Phase-II commercial complex Fruit Market, Narwal Fruit Mandi Jammu, Ward-49 adjoining with Head Branch of J&K Grameen Bank against JMP-2032/Unified Building Bye-laws 2021” and sub-title, “As per Unified Building Bye-laws 2021, under Section 5.2.1.2, Table No. 5-4, area falling under index of 300-750 Sqm, owner is entitled to 50% construction of total plot area and 50% open area, FAR-180, height 14 mt , owner is mandatory to observe setbacks of basement by leaving 10 ft from all 4 sides to maintain planned development of Jammu city but owner covered 100%plot area despite her total plot area falling under Section 5.2.1.2, Table No. 5-4 under UBBL-2021”.
In this regard, JMC on Feb 12 under caption, “Fact Check” on their official twitter handle now known as X in a rebuttal to this story clarified that Fruit Mandi Complex is an integrated scheme of development of development Projects with commercial plots and parking lots formulated by JDA. The commercial plots have been leased out to the people with 100% coverage and fixed FAR as per their lease agreement. JMC issues permission in these types of schemes as per coverage confirmation given by JDA with respect to lease agreement and JK UBBL-2021 does not implement in these plots which are part of a scheme with separate parking lot provisions as per JDA. The said case has been approved within policy of JDA.
However when a RTI filed before PIO Secretary JDA Jammu in the office of Vice Chairman, JDA dated 13-3-2025 to provide photocopy of “Integrated Scheme” of JDA for development projects with commercial plots and parking lots in Fruit Mandi Complex launched way back in the year Oct 1995 with terms and conditions. Please also provide photocopy information whether this scheme was time-bound or it is still in vogue as on date.
The PIO (Secretary JDA) in this regard vide No.JDA/RTI/PIO/2025/112/22 dated 24-3-2025 replied that information sought by information seeker doesn’t pertain to his office claiming that Fruit Mandi Complex Narwal has been transferred to Horticulture Planning and Marketing Department vide J&K Govt order No. 348/Agri/Horti/P&M/2008 dated 12-12-2008 as if they have no concern with ongoing constructions in Fruit Mandi Complex Narwal. In para-2 of same RTI application request was made to provide photocopy information whether JDA has adopted Unified Building Bye-laws 2021 vide notification No.13-JDA of 2021 dated 2-12-2021 and whether all mandatory Master Plan or Zonal Plan Regulations regarding land use, modifications are also bound on JDA to act strictly as per UBBL-2021. Please also provide photocopy information whether JDA has some exceptions with regard to UBBL-2021, if so please provide photocopy details of the same .
In this regard PIO of JDA replied that copy of UBBL-2021 is already placed on JDA websitew.w.w.jda.jk.gov.in and the same can be downloaded from there But didn’t provide simple information whether JDA has adopted Unified Building Bye-laws 2021 vide notification No.13-JDA of 2021 dated 2-12-2021 and whether all mandatory Master Plan or Zonal Plan Regulations regarding land use, modifications are also bound on JDA to act strictly as per UBBL-2021 and also whether JDA has some exceptions with regard to UBBL-2021.
In Para-3, request was made to provide photocopy information whether JDA from 2-12-2021 to onwards approving site plans since when UBBL-2021 came into being as per UBBL-2021, if so please provide information whether schemes and relaxations launched by JDA before enforcing of UBBL-2021 now provided as per UBBL-2021 particularly with regard to Integrated Scheme of JDA launched in 1995. In Para-3, the PIO replied that , JDA has been approving site plans as per UBBL-2021 since its approval from Board of Directors of JDA in the meeting held on 1-12-2021 which totally contradicts claims of JMC which says that Fruit Mandi Complex is an integrated scheme of development of development Projects with commercial plots and parking lots formulated by JDA. In Para-4, asked information was to provide photocopy of NOC/lay out plan approved granted by JDA in favour of Vimla Rani wife of Lt Raj Kumar r/o Trikuta Nagar Jammu owner of commercial site-5 measuring 90×50 (4500 sqft) at Fruit Mandi Complex Narwal , Phae-II, Ward-49 vide application No. JMC/2023/5070 dated 27-5-2024 allowing owner hundred percent plot area under construction measuring nearly 418.19 sqm(4500 Sqft) without asking owner to observe setbacks allowing owner new Basement-1 commercial measuring 418.19 sqm, new ground floor commercial measuring 418.19 sqm(4500 sqft).
In this regard, the PIO replied that area falls under the jurisdiction of JMC thereby itself admitting that they have nothing to do with NOC/lay out plan granted in favour of Vimla Rani wife of Lt Raj Kumar r/o Trikuta Nagar Jammu owner of commercial site-5 measuring 90×50 (4500 sqft) at Fruit Mandi Complex Narwal , Phase-II, Ward-49 vide application No. JMC/2023/5070 dated 27-5-2024 allowing owner hundred percent plot area under construction measuring nearly 418.19 sqm(4500 Sqft) without asking owner to observe setbacks allowing owner new Basement-1 commercial measuring 418.19 sqm, new ground floor commercial measuring 418.19 sqm(4500 sqft). Here also claims of both JDA and JMC contradict each other as JMC says JMC issues permission in these types of schemes as per coverage confirmation given by JDA with respect to lease agreement and JK UBBL-2021 does not implement in these plots which are part of a scheme with separate parking lot provisions as per JDA.
In Para-5, the asked information was to provide photocopy of lease deed agreement granted in favour of owners M/S Jammu Auto Finance Corporation through Sham Lal s/o Jai Gopal, Shiv Kumar s/o Roshan Lal, Raj Kumar Anand s/o Sikandar Lal of commercial site-5 at Fruit Mandi Complex, Narwal, Jammu dated 27th Sep, 1996 granting owner to cover 100% plot area without asking owner to maintain setbacks. In this regard, the PIO surprisingly replied that that sought information doesn’t pertain to his office claiming that Fruit Mandi Complex Narwal has been transferred to Horticulture Planning and Marketing Department vide J&K Govt order No. 348/Agri/Horti/P&M/2008 dated 12-12-2008 but lease deed agreement granted in favour of owners M/S Jammu Auto Finance Corporation through Sham Lal s/o Jai Gopal, Shiv Kumar s/o Roshan Lal, Raj Kumar Anand s/o Sikandar Lal of commercial site-5 at Fruit Mandi Complex, Narwal, Jammu dated 27th Sep, 1996 granting owner to cover 100% plot area without asking owner to maintain setbacks which was deliberate attempt to hide wrongdoing done earlier and now by JDA by passing the buck on JMC and in turn JMC on JDA but no one is claiming neither JMC nor JDA responsibility of ongoing constructions at Fruit Mandi Complex Narwal.
In Para-6 of same RTI application asked information was to provide photocopy information how many floors the owner entitled on basement at commercial site-5, Fruit Mandi Complex Narwal Jammu and whether floors will be granted as per Integrated Scheme of JDA or as per norms of UBBL-2021 with height in both the cases.In this regard, the JDA PIO replied that area falls under the jurisdiction of JMC when asked information was to provide information how many floors the owner entitled on basement at commercial site-5, Fruit Mandi Complex Narwal Jammu and whether floors will be granted as per Integrated Scheme of JDA or as per norms of UBBL-2021 with height in both the cases when as per JMC it issues permission in these types of schemes as per coverage confirmation given by JDA with respect to lease agreement and JK UBBL-2021 does not implement in these plots which are part of a scheme with separate parking lot provisions as per JDA.

In this regard the higher authorities must intervene and should put the record straight whether all the constructions at Fruit Mandi Complex at Narwal will be done as per integrated scheme of development of development Projects with commercial plots and parking lots formulated by JDA claiming these commercial plots have been leased out to the people with 100% coverage and fixed FAR as per their lease agreement.
