The issue of commercial shops being constructed in residential areas without Jammu Municipal Corporation (JMC) approval, particularly in adjoining areas of Sainik colony, has sparked concerns among law-abiding citizens who have purchased commercial sites.
According to aggrieved locals, JMC’s enforcement staff seems to be facilitating these unauthorized constructions. Commercial buildings are being raised on residential plots without adhering to approved site plans and building bylaws.
Despite notices being served, JMC fails to take concrete actions against violators, allowing them to continue constructions. Constructions are deviating from approved plans, ignoring setbacks, and changing land use without permission. Law-abiding citizens who purchased commercial sites feel aggrieved due to the unfair advantage gained by those constructing without approvals. Unauthorized constructions are causing traffic congestion, environmental hazards, and disturbance to the peace of the area.
JMC has served notices to owners, but follow-up actions are often lacking, allowing constructions to continue. Further land use change permission costs worth lacs and to avoid such expenses they seek favour of enforcement staff who remains ready to offer unfair help at the cost of serious loss to Govt exchequer.
To put the things in perspective, five commercial shops using tin shed have been constructed on residential plot in Ward 55 on Jodhamal Public School road without JMC permission.
Despite aggrieved locals bringing the same into kind notice of concerned Enforcement Inspector Ashwani Kumar in Ward-55 Village Dilli on main PWD road ,he lent only deaf year what to think of informing higher authorities in this regard as a result of which these tin shed shops have started operation without any parking facility and without permission from any of concerned authorities.
Similarly shutter was fitted on a shop whose construction was going on for last few days in Ward-55 Village Dilli on Jodhamal Public School road without JMC permission here too with the help of concerned Enforcement Inspector Ashwani Kumar and the soon shop will be operational.
Likewise the construction of shop is going on in village Dilli ,Ward 55 on Jodhamal Public School road without JMC permission and despite bringing the same into kind notice of Enforcement Inspector Ashwani Kumar he didn’t ask owner to stop construction of unauthorized shop without JMC permission. Similarly finishing work of another shop is also going on in village Dilli ,Ward 55 on Jodhamal Public School road without JMC permission but all these above mentioned unauthorized constructions either completed or going on covering hundred percent area without maintaining setbacks completely against UBBL-2021 with the support and patronage of Enforcement Inspector Ashwani Kumar who is king pin of unauthorized constructions in Ward-55.
In the light of above, one thing is sure that due to lack of concern by concerned Enforcement Inspector Ashwani Kumar despite bringing the same into his kind notice, these violated constructions may not be in notice of JMC higher authorities but now after publishing of this story, Commissioner JMC should put straight questionnaire to Enforcement Inspector Ashwani Kumar and also why he didn’t report violations before his higher authorities means he has offered unfair patronage to violators to meet his unfair needs.
