The owner didn’t raise residential construction on ground floor like bedroom, lobby, kitchen, toilet , cut out for ventilation , staircase towards front side but to hoodwink general public and JMC Authorities kept 2 ft size two windows and small size door 2 ft in size in middle of these two windows to show construction being residential to hide construction of full-fledged commercial hall on ground floor .
Owner didn’t leave front 9 ft when he was duty bound to leave 12.5 ft besides extending 2 ft gallery on ground floor and also didn’t leave 7 ft 9 inch from backside and left only 3 ft besides didn’t leave open area of plot 527 sqft ,further installing round iron stairs from ground to third floor which was strongly objected by immediate neighbors disturbing their privacy

JMC’s eyewash action is now an established fact wherein they under public pressure and when print media highlights commercial construction on residential plot, they visit only that site but don’t look at other commercial constructions and leave without taking action against owner and infect guide such violators how to save such violated construction . The live example of this is today’s visit led by Dy Commissioner South (Incharge Enforcement Section) Lal Chand accompanied by Enforcement Officer Anil Kashyap and Enforcement Inspector Rattan Lal at residential site 360/7 at 1:00 PM and left site at 1:25 PM where slab work of commercial hall completed on first floor on existing violated ground floor commercial hall only after Print Media today highlighted ongoing construction of commercial hall on ground floor earlier and slab work on first floor on 4-9-2024 but left side without taking any action against owner. Moreover it is highly surprising to note that during this visit the owner and his relatives were already present at the site as if they were asked by enforcement staff which is technically not done while visiting site to avoid any verbal brawl at the site which beyond any doubt proves nexus between owner and enforcement staff. However enforcement staff after visiting site in question didn’t visit other sites where similar commercial construction on residential plots going on in same ward on walking distance and also which have already been highlighted in print media along with relevant details and pictures, one such site which was already highlighted wherein commercial hall construction going on from residential plot is 250-C, Sector-2, Ward-50.
To put the things in perspective, one Chander Bhushan s/o Tarlok Nath r/o 20-A Gandhi Nagar Jammu owner of residential plot 250-C having total plot area 1487.50 Sqft measuring 25 x54+ 65/2 (1487 .50 Sqft) , Sector-2, Ward-50 on main road of Channi Himmat Housing Board colony got approved a residential site plan from JMC vide No. 1430/JMC/BS/2021 dated 22-2-2022. According to approved site plan, the owner was allowed ground plus two floors measuring 960 Sqft each with setback including front -12 ft 6 inch, Rear- 7 ft 9 inch. The height of three floors structure excluding Mumty was allowed 33 ft from front road level and accordingly paid residential building fee Rs 6720 for permitted construction area and also paid labour cess Rs 34560. The owner as per approved residential site plan was to construct bedroom measuring 12 ft-9 inch x 10ft-8 inch, stairs in case of duplex house 12 ft 3 inch towards front side , backside toilet and cut out towards left side for ventilation to lobby ,Kitchen and bedroom and backside dressing room and verandah also on three floors.
It deserves mentioning here that , the owner Chander Bhushan after getting site plan approved from JMC didn’t start construction and further sold out on 29-6-2022 to one Vishav Deepak Suri and his wife Bhanu Suri s/o Krishan Lal Suri and Radha Suri r/o House No. 60/6 Channi Himmat Jammu measuring 50×100 Sqft purchased by Krishan Lal Suri in the year 2009. The new owner Suri didn’t get site plan approved from JMC and infect started commercial hall construction on RCC Pillars without any internal brick walls partition against residential site plan approved in favour of previous owner Chander Bhushan in the month of April 2024 without maintaining setbacks. The owner didn’t raise residential construction on ground floor like bedroom, lobby, kitchen, toilet and also cut out for ventilation and also staircase towards front side was also not constructed but to hoodwink general public and JMC Authorities kept 2 ft size two windows and small size door 2 ft in size in middle of these two windows to show construction being residential and also didn’t leave area as mandatory in setbacks like the owner left front 9 ft when he was duty bound to leave 12.5 ft besides extending 2 ft gallery on ground floor and also owner was duty bound to leave 7 ft 9 inch but owner left only 3 ft from backside also didn’t kept open area of plot 527 sqft and also installed round iron stairs from ground to third floor which was strongly objected by immediate neighbors disturbing their privacy.
Worthwhile to mention here that this commercial construction was duly brought into kind notice of concerned enforcement staff but they did nothing after joining hands with owner as a result of which owner getting full patronage from enforcement staff not only completed commercial hall construction on ground floor very easily completed commercial hall construction on first floor both measuring 1250 sqft against permitted 960 sqft each and now at present the construction of 2nd floor is going on RCC Pillars will be another commercial hall after completion of construction. Sadly JMC yet to take cognizance of this commercial construction on main road of Channi Himmat Housing Board colony despite strong resentment among locals and also dereliction of duty on part of enforcement staff to stop commercial construction on residential plots.

- Nepotism and favoritism at its best in PHE Division Akhnoor in case of Kamini Kumar at present working Head Assistant at PHE Division Nowshera has wrongly drawn his salary/leave salary from 2011 to 2024 and has served in PHE Division Akhnoor w.e.f. 1988 to 2024 as daily wager, class ivth, Junior Assistant, Senior Assistant and not served anywhere except his present place of posting in Nowshera PHE Division despite his transfers with promotions
- JMC continues to act as mute spectator, violators raising choice construction with help of enforcement staff against JMP-2032, UBBL-2021, JMC Act 2000
- JMC fails to implement verdict of High Court Jammu dated 9-10-2024 in case of residential house 584/4, Ward-50 Channi Himmat by allowing owner to continue running big shop under name & Style Durga Dutt Mart after converting drawing room making land use change from residential to commercial when JMC was at liberty to proceed against owner in case he doesn’t restore back drawing room by closing shop on residential ground floor and use premises purely for residential purpose only and de-seals shop when owner doesn’t fulfills conditions of de-sealing order
