Commissioner JMC order vide No. JMC/Estt/14387-93 dated 15-3-2024 ordered fresh allotments in Wards for smooth functioning of Enforcement Wing particularly Enforcement Inspectors shall maintain proper registers of each Ward and take action against violators as admissible under rules with proper entry on action taken register has proved mere eyewash as Enforcement Inspectors acting absolutely contrary to this order
JMC by allowing running service station from residential plot has set very wrong precedence which will definitely encourage others to make land use changes on their own and not only this promoting such developments will pave way for big players to raise huge commercial constructions and business in residential areas against Unified Building Bye-laws 2021 and JMP-2032 which in turn will convert zonal planned colonies into concrete jungle and wherein no future Mater plan will be successful to address damage being done now

To put the things in perspective, JMC earlier permitted owner Swarn Singh s/o Partap Singh of 224/2 Channi Himmat Housing Board Zonal planned colony to raise violated two bedroom set against approved site plan and despite locals expressing strong resentment against violated construction, concerned staff in JMC particularly Enforcement Inspector and Enforcement Officer didn’t pay any heed to this violated construction. Now the owner as encouraged and supported by JMC concerned staff has now started service station under name and style “Mahakaal Car Wash” by covering hundred percent area under Teen shed from residential plot.
Sources have confirmed that Swarn Singh s/o Partap Singh’s legal heir Rajeev Singh s/o late Swarn Singh has sold out his plot and the new owner the owner has rented area of his residential plot other than construction area of two bed room set to one Neeraj Bali who after raising Tin shed without JMC permission started running service station under name and style “Mahakaal Car Wash” from March 20 2024 which has been strongly resented by locals but the concerned JMC staff particularly Enforcement Inspector Gagan Kumar assigned duty in Ward-50 still turning deaf ear to public grievances which has badly affected Zoning regulation and has badly affected planned development of Jammu city. Besides under recently approved Building Bye-laws 2021 and even under JMP-2032, there is absolutely no provision or any relaxation to allow commercial activity from residential plot after getting residential site plan approved from JMC and that too in thin residential areas. Moreover despite Commissioner JMC order vide No. JMC/Estt/14387-93 dated 15-3-2024 ordered fresh allotments in Wards for smooth functioning of Enforcement Wing particularly Enforcement Inspectors shall maintain proper registers of each Ward and take action against violators as admissible under rules with proper entry on action taken register. According to order, the Enforcement Inspector shall submit action taken report to the concerned I/C CRO/I/C EO for its onward submission to Dy Commissioner North or Dy Commissioner South for action under rules in vogue. Unfortunately had this order by Commissioner JMC implemented on ground, there would have been serious check on violations and the present case where washing station has been allowed to run from residential house making land use change and that too without JMC permission would not have established openly and brazenly in residential area if concerned Enforcement Officer has taken action timely and properly.

Jammu Municipal Corporation (JMC) has badly failed to take decisive action against illegal construction and commercialization of residential areas in Municipal areas. Due to the pressure from people having close political connections the illegal transformation is going on with impunity while the enforcement agencies are turning a blind eye towards the unlawful activities. Despite law passed against such violations, JMC has failed to stop conversion of residential colonies into commercial spaces, which has led to chaos in many areas in the urban centres.
Jammu Municipal Corporation has badly failed to exercise its powers with respect to unauthorized construction in Municipal areas. In some cases permissions have been obtained for construction and reconstruction of residential use and in the process structures have been raised much in violation of the sanctioned permission and use other than permitted by the competent authorities.
