One Ajay Wangnoo Raina s/o Brij Nath Wangnoo r/o Prushyal, Habakadal, at present 21, Ajit Colony, extension Camp Gole Gujral,Talab Tillo Jammu owner of piece of commercial land measuring 18.5 Marlas falling under Khasra No. 88/1, Khata No.261, Khewat No.23 at Paloura right side of plot, Ward 61 adjoining with Sanjeevani Sharda Kendra sold out this piece of land equally to Shivani Sharma wife of Ankush Badyal r/o B-35, Bharat Nagar, Talab Tillo(Shanker Vihar), The same was registered in Court of law on 14-10-2019 measuring 233.10 sqm with size 36.79 mtr x 6.60 mtr as commercial. Similarly another half of piece of land in question was sold out to one Anpurna Raina Jyotshi wife of Suneet Jyotshi r/o House No.15, Ajit Colony Gole Gujral Jammu falling under Khasra No. 88/1, Khata No.261, Khewat No.23 at Paloura left side of plot, Ward 61 adjoining with Sanjeevani Sharda Kendra. The same was also registered in Court of law on her name on 14-10-2019 measuring 233.80 sqm as commercial with size 37.20 x 6.66 mtr.
Both the owners after registry of land in their names surprisingly applied for residential site plans approval from JMC. Accordingly Shivani Sharma wife of Ankush Badyal r/o B-35, Bharat Nagar, Talab Tillo(Shanker Vihar) got approved residential site plan from JMC vide No. 63/JMC/BS/2024-25 dated 6-5-2024 allowing owner new ground floor residential 147.09 Sqm and two other floors on it in equal size. The owner was mandatory to observe setbacks including front-9.66 mtr, Rear-3.71 mtr. The height of building was allowed 10.12 mtr excluding Mumty/lift/upto ridge level whichever is applicable and accordingly paid building fee Rs 23444 for permitted construction area as residential with open plot area 86.01 Sqm. The owner as per approved site plan was duty bound to construct stairs, lift, kitchen, bed room, lobby with toilet.
Similarly 2nd owner Anpurna Raina Jyotshi wife of Suneet Jyotshi r/o House No.15, Ajit Colony Gole Gujral Jammu falling under Khasra No. 88/1, Khata No.261, Khewat No.23 at Paloura left side of plot, Ward 61 adjoining with Sanjeevani Sharda Kendra also got approved residential site plan from JMC vide No. 154/JMC/BS/2024-25 dated 31-5-2024 allowing owner new ground floor residential 149.4 Sqm and two other floors on it in equal size. The owner was mandatory to observe setbacks including front-9.97 mtr, Rear-3.62 mtr. The height of building was allowed 10.12 mtr excluding Mumty/lift/upto ridge level whichever is applicable and accordingly paid building fee Rs 23669 for permitted construction area as residential with open plot area 84.20 Sqm with cut out 6mtr x 1.5 mtr towards Sharda Sanjeevni Kendra. The owner as per approved site plan was duty bound to construct stairs, lift, kitchen, bed room, lobby with toilet but nothing of this sort is visible at the site as it is altogether commercial construction without any supporting walls and also thorough common entrance from within making it joint construction. to mention here that both the owners purposefully applied for residential site plans on commercial land to escape land use change fee from JDA/JMC worth lacs serious loss to their respective exchequers but raised commercial construction with central common wall and joint construction with common entrance against approved residential site plans, Now the walls of this commercial shopping Mall stands raised and shuttering work is in progress and there is every likelihood that within couple of days the slab work will be completed covering hundred percent area without observing mandatory cutouts blocking ventilation and sunlight of adjoining Sanjeevni Sharda Kendra. We sincerely hope that concerned will look into this to ensure residential construction as per approved residential site plans and if land use change to happen the requisite fee owe to JDA/JMC can be paid by owners.
