Owner also didn’t observe mandatory setbacks including front 6.62 mtr (22 ft), Rear-2.13 mtr (7 ft), Side-1, 2.0 mtr (6.5 sqft) and Side-2, 0 mtr besides not keeping area open as 137.94 sqm and also extending gallery 5 ft towards front side and also covering area of side-1 (6.5 ft) with 4 ft gallery using beams beyond approved site plan

Smt Raj Rani wife of Prem Pal Sharma purchased a residential plot 530/4 measuring 40×80 (297.31 Sqm) (3200 Sqft) on main road 60 ft of Channi Himmat Housing Board Colony Ward-50 from original alottee Major P Raina s/o Major Narotam Dass r/o Quarter No. 16 Corps Camp 56 APO costing worth crores and later on got transferred this plot on his name from Housing Board after depositing requisite fee. The owner accordingly applied for residential site plan from JMC vide application No. JMC/2023/6461 dated 4-11-2023 and got approved residential site plan vide No.1873/JMC/BS/2023-2024 dated 19-2-2024 allowing owner ground floor + two floors residential with ground floor measuring 159.37 (1715 Sqft) ,new floor-1 residential 139.95 sqm (1506 Sqft) and new floor-2nd residential 139.95 Sqm (1506 Sqft). The maximum height of building was allowed 10.10 mtr (33 ft) from front road level excluding mumty/lift up to ridge level whichever is applicable The owner was duty bound to observe mandatory setbacks including front 6.62 mtr (22 ft), Rear-2.13 mtr (7 ft), Side-1, 2.0 mtr (6.5 ft) and Side-2, 0 mtr. According to residential approved site plan the owner was to construct Porch area on right side towards front of main entry gate with toilet and extreme left side bed room, kitchen towards back of porch area with lobby, 2nd bed room and third bed room with attached bathroom and also one separate toilet with open area as 137.94 sqm. The owner accordingly paid residential building fee as Rs 49142. Aggrieved locals approached management of this newspaper regarding commercial construction along with pictures of ongoing construction claiming that ongoing construction belongs to well known name Gaurav Traders running multiple businesses and to which our correspondent along with team visited site and found their claims true that owner contrary to approved residential site plan on ground floor didn’t start residential construction as there is no construction of porch, Kitchen, toilet and lobby and one bedroom behind lobby with two bath rooms and infact constructed big size commercial hall on RCC pillars completely changing internal and external dimensions and also raising stairs from backside rather than where it was allowed towards left side along with Lobby as granted in case of duplex home as per approved site plan. The owner also didn’t observe mandatory setbacks by not keeping area open as 137.94 sqm besides extending gallery 5 ft towards front side

As on date shuttering work is going on and in couple of days slab work will be completed.In light of above the enforcement section should visit site and enquire why the ongoing construction of ground floor is not going on as per approved residential site plan and also when building material is spreading on road which is strictly prohibited before owner completes slab work on ground floor. The enforcement section is quite empowered to stop any construction going against approved site plan and incase if construction goes on against approved site plan the site plan approved deemed cancelled.
