Owner didn’t start construction after getting site plan approved from JMC till first week of March 2023 when he started plinth work but by then the validity of approved site plan had lapsed and didn’t get fresh site plan approved from JMC as per Unified Building Bye-laws 2021

When enforcement Inspector Jasbir Singh didn’t listen to locals complaints, aggrieved locals complaint violative construction before Commissioner JMC highlighting damage to plan development and well laid down existing symmetry besides obstructing their ventilation and sunlight, no action taken against owner

Aggrieved people in Municipal areas are at great loss to understand why LG Administration is so lenient towards Jammu Municipal Corporation notwithstanding the fact that print media consistently and regularly highlighting wrong doings of JMC enforcement staff resulting in boom in unauthorized constructions in Municipal areas particularly in Channi Himmat Jammu against JMP-2032 and even against Unified Building Bye-laws 2021. Last but not the least there is no one in JMC to entertain various serious nature complaints against enforcement staff which is hand in glove with violators which in turn badly damaged planned development of Jammu city.
To put things in perspective, one Sanjeev Rattan s/o Mohan Lal purchased a corner residential plot No. 244 –B, Sector-4 Zonal planed colony Channi Himmat measuring 40×80 Sqft having approach roads towards left and right side from original alottee RK Khanna r/o New Delhi . Accordingly the owner got transferred ownership rights of plot in his name and applied for site plan approval from JMC vide application No. 7173 dated 3-10-2017. JMC approved site plan of owner vide No. 211/JMC/BS/2018 dated 18-8-2018 for residential purpose allowing owner ground and first floor as per JMP-2032 which was enforced vide SRO No. 90 of 2017 dated 3-3-2017 by Housing and Urban Development Department. According to lapsed site plan, the owner was entitled 55% construction and was duty bound to leave 15 ft from front side, rear 6.5 ft, side -1 6.5 ft and vacant area of plot was fixed as 45%
It deserves mentioning here that the owner didn’t start construction after getting site plan approved from JMC till first week of March 2023 when he started plinth work but by then the validity of approved site plan had lapsed on 17-8-2021 which remains valid for a period of three years only. Which means that the construction undertaken by owner was as per lapsed site plan and didn’t get fresh site plan approved from JMC as per Unified Building Bye-laws 2021.
Worthwhile to mention here that locals strongly protested ongoing construction without JMC permission and the same was brought into kind notice of then Enforcement Inspector and before he could do anything was transferred 6-3-2023 and new Enforcement Jasbir Singh joined ward -50 on 8-3-2023 who was also thoroughly briefed by locals about unauthorized construction but all in vain as he didn’t respond to complaints of locals and thus owner continued violated construction without getting new site plan approved from JMC and as a result of which violated ground and first floor construction was completed without maintaining mandatory setbacks .

When enforcement Inspector Jasbir Singh didn’t listen to locals complaints, aggrieved locals complaint violative construction before Commissioner JMC highlighting damage to plan development and well laid down existing symmetry besides obstructing their ventilation and sunlight. Sources have disclosed that when JMC Commissioner sought reply from Jasbir Singh over complaints, Jasbir Singh wrongly reported that the construction is going on as per approved site plan but unfortunately the same was not cross-checked which smokes nexus between enforcement staff and owner to raise violative construction.
JMC Commissioner must order a detailed enquiry into the case and should constitute a team to verify claims of Enforcement Inspector and also actual report of construction at the site and also how fresh construction was allowed on lapsed site plan and without getting fresh approval of site plan from JMC. Moreover Commissioner should ensure that public complaints are properly entertained and should initiate strong action against enforcement staff and complainants are not timely briefed as to what happened with their complaints bringing bad name to JMC for fulfilling their vested interests at the cost of JMP-2032 and Unified Building Bye-laws 2021.
