Owner already facing Housing Board warning of termination of lease deed for converting residential plot into commercial and the same got published in print media vide DIP/J-4094-P/19 Dated 4-1-2020 and plot No. 21/4 Channi Himmat was at serial No. 116 accused of making land use change from residential to commercial by running full-fledged Bakery from residential house dismantling compound wall towards front side without any parking facility and whosoever visiting this Bakery parks vehicle on main road causing serious traffic jams in the area
Owner wrongly replied to Housing Board notice that he has started Bakery from residential House, keeping in view requirements of locals claiming that the commercial sites allotted by Housing Board 70% of them haven’t been developed whereas the reality was that the commercial sites allotted by Housing Board were fully functional and properly catering needs of residents of Sector-3 and Secor-2 .
One of alottees Bimla Sharma owner of commercial site 8 in Sector-3 who was upset and disappointed over land use change filed a case in High Court against SRO-391 and the trial is still going on vide OWP 2115 of 2017 where plot 21/4 where JMC and Housing Board are parties on the ground that their fundamental rights have been violated by allowing residential sites to convert into commercial ones as those who have purchased commercial sites have paid in crores from Housing Board.
Commissioner JMC must take serious cognizance of this and should immediately send team to have first hand appraisal of land use change at the site where owner without any fear of competitive authority openly and brazenly converting residential ground floor into commercial one and also extending business area on his own without JMC permission.

JMC’s long rope to its enforcement staff and then lack of proper supervision on its part has resulted in boom in unauthorized constructions in Channi Himmat area where the peace of law abiding citizens has been badly shattered due to rise in land use changes from residential to commercial. To put the things in perspective, one Meenakshi D/O Raj Kumar C/O Gaytri Sansthan, Prem Nagar Jammu was allotted residential plot 21/4 measuring 40×80 on main road of Sector-3 and Sector-4 Sqft Zonal Planned colony Channi Himmat Jammu on 24-5-1996 for residential purposes . Thereafter one Sanjeev Gupta son of Attar Chand Mahajan and Raj Rani became attorney holder of residential plot 21/4 Channi Himmat Jammu. Sanjeev Gupta accordingly constructed residential house covering hundred percent area without maintaining setbacks and also raised compound wall towards front side with small height in the year 2007. The owner however later removed bedroom and drawing room towards front side and established bakery shop and thus making land use change openly and brazenly in the year 2007-2008 from earlier selling curd only by dismantling compound wall and keeping entrance also. With a view to extend his business further from residential house got commercial electricity connection vide consumer ID 0102010023364 under name and style Big Bakers and as a result of which managed personal transformer by installing electric poles covering road area instead of installing transformer within his premises with the help of then corrupt PDD officials.
In this regard serious cognizance was taken by Housing Board which served public notice to alottees of Housing Board warning termination of lease deed who have converted residential plots into commercial and the same got published in print media vide DIP/J-4094-P/19 Dated 4-1-2020 and plot No. 21/4 Channi Himmat was at serial No. 116 accused of making land use change from residential to commercial by running full-fledged Bakery from residential house dismantling compound wall towards front side without any parking facility and whosoever visiting this Bakery occupied road causing serious traffic jams in the area. Besides the owner also managed to install electric poles using personal transformer using public road which is strongly prohibited as per JMP-2032 and Unified Building Bye-laws 2021.

Contrary to his claims the truth was that those who had been allotted commercial site costing worth crores were very upset and disappointed over this move and among them there was also one Bimla Sharma who has already filed a case in High Court against SRO-391 and the trial is still going on vide OWP 2115 of 2017 where plot 21/4 along with JMC and Housing Board are parties on the ground that their fundamental rights have been violated by allowing residential sites to convert into commercial ones as those who have purchased commercial sites have paid in crores from Housing Board.
When all this was going on, JMC didn’t take any action against owner and as a result of which, the owner Sanjeev Gupta now moving ahead to convert whole of ground floor into commercial one from 30 July 2023 by installing steel structure and thus raising area of business towards front side by completely removing compound wall and further approaching main road against established norms . The owner now running full-fledged Bakery under name and Style Big Bakers and further extending business area by installing iron rods and preparing to cover further area towards front side with iron shed during the past one week without JMC permission and also when he is already facing trial into notice of Housing Board/JMC for converting residential construction into commercial and facing sword of cancellation of lease deed as land use change can’t be permitted neither under JMP-2032 nor under Unified Building Bye-laws 2021 in residential areas of Zonal planned colonies. Commissioner JMC must take serious cognizance of this and should immediately send team to have first hand appraisal of land use change at the site where owner without any fear of competitive authority openly and brazenly converting residential ground floor into commercial one and also extending business area on his own without JMC permission.
