Owner on his own started unauthorized rebuilt of existing shop on ground floor and residential house on first floor by enhancing area of shop by extending gallery and even removing existing entry gate on RCC pillars to convert it into full-fledged commercial structure and at present 2nd floor construction on RCC pillars going on under nose of JMC authorities
Surprisingly JMC has so far taken no action against owner when from three months this unauthorized construction is going on what to think of serving owner any BOCA notices when enforcement staff is hand in glove with owner in raising unauthorized construction.
Secretary JMC while replying to RTI application vide letter No. JMC/CEO/S/237-38 dated 11-11-2023 and vide letter No. JMC/CEO/S/253-54 dated 26-12-2023 wrongly claimed that as per report the entire gallery has already been demolished and the work stopped at present when the gallery was not demolished and also the work was also never stopped and as a result of which now 2nd floor construction on RCC pillars is going on at present at the site in question.

Talla Jewellers Pvt Ltd. Gandhi Nagar. 4 A/B, Gandhi Nagar, Jammu purchased already constructed shop on ground floor and residential house on first floor with proper entry gate measuring nearly 5 ft to reach at first floor residential towards front side of main road of Channi Himmat Sector-3, Ward-51 a private land of village Channi Himmat comprising Khasra No. 477 Min from one Sanjeev Gupta couple of months back measuring nearly 900 Sqft including both shop and residential first floor besides separate passage for shop and residential first floor costing worth crores. This shop and residential house is adjoining with Engineering Institution. Worthwhile to mention here that owner after taking possession of shop and residential house without getting site plan approved from JMC started renovating existing shop on ground floor and residential house on first floor by enhancing area of ground floor shop by raising RCC pillars and extending gallery towards main road side with a view to remove entry gate later on to give existing shop an enlarged look and even making unauthorized extensions on first floor residential house in such a way that it becomes full-fledged commercial structure as single entity with the help of enforcement Inspector Ram Khajuria deputed in the area without any provision for parking facility. JMC however conveniently forgotten the Building Bye-laws 2021 which clearly states that where the whole or part of a building is demolished or altered or reconstructed, except where otherwise specifically stipulated, these building Bye-laws shall apply to the whole building whether existing or new but in the present case the owner didn’t seek requisite permission from JMC and concerned staff despite knowing all this allowed owner to continue with unauthorized construction that too commercial construction in residential area.The owner, as per guidance of Enforcement Inspector earlier raised commercial construction by putting on iron sheet towards entry gate to hide unauthorized construction without JMC permission which now has reached 2nd floor wherein at present 2nd floor construction is going on RCC pillars and connecting the ground floor construction with 2nd floor construction by removing walls and is all set to give shape to existing and new construction altogether commercial look. The owner is all set to raise commercial structure by enhancing size of shop and keeping provision of stairs inside to convert residential house on first floor and shop a single entity commercial structure but surprisingly JMC has so far taken no action against owner when from three months this unauthorized construction is going on what to think of serving owner any BOCA notices when enforcement staff is hand in glove with owner in raising unauthorized construction.JMC is definitely shielding unauthorized construction of Talla Jewellers which is evident from the fact that when in this regard RTI application dated 7-10-2023 was filed to seek photocopy information whether JMC has granted permission to Talla Jewellers in raising unauthorized construction in Sector-3, Ward-51 Channi Himmat without JMC permission and maintaining mandatory setbacks as owner has started unauthorized renovation of existing shop on ground floor and residential house on first floor by enhancing area of shop by extending gallery and even removing existing entry gate on RCC pillars to convert it into full-fledged commercial structure. Please also provide information if any BOCA notices served to owner. A s the reply was contrary to reality at the site ,a First Appeal was filed dated 16-11-2023 which in its decision directed Secretary JMC to provide correct information to information seeker but the Secretary JMC did not abided by First Appellant Authority order and Secretary JMC again vide letter No. JMC/CEO/S/253-54 dated 26-12-2023 again provided wrong information entire gallery has already been demolished and the work stopped at present till date when the gallery was not demolished and also the work was also never stopped and as a result of which now 2nd floor construction on RCC pillars is going on at present at the site in question. Further the gallery which was claimed to be demolished by Secretary JMC is rebuilt and fully restored.
As a result of leniency on part of JMC enforcement staff and no follow-up taken , a boom has been witnessed in unauthorized constructions in Channi Himmat Govt Housing Board colony. Surprisingly when the same is brought into notice of enforcement staff, as usual they are found more inclined towards violator by saying that action is being taken against them when they in reality extend every possible help to violators. Besides JMC has now become habitual of taking no action against violators at the initial stage of violation and only under pressure serves backdate COBO notices to save its skin and in this regard their main weapon is Dispatch register which is used to prove that JMC taking action against violators which is being used only to hoodwink general public and to make false claims of taking action against violators which is a serious offence and the same deserves to be thoroughly investigated lest JMP-2032 should be badly damaged. Concerned authorities who have already closed their eyes must wakeup from deep slumber and should intervene immediately so that future generations don’t suffer when unplanned construction will reach to such an extent that no Mater Plan can revive it.

- Existing violated structure on private land falling under Khasra No. 4 Min, Ward-51, Channi Himmat earlier sealed, site plan withdrawn, then restored without removing violations now undergoing complete renovation and conversion from sanctioned mixed use of both residential and commercial to full-fledged commercial halls on three floors measuring 10000 sqft each to run big size shopping mall without JMC permission but with help of enforcement staff deployed in Channi Himmat
- JMC firstly allows establishment/running of unauthorized markets having shops using tin shed without parking facility and then in eyewash duty takes action on pick and choose basis by serving demolition notice to owner of tin sheds in Trikuta Nagar extension but sparing action against well known “Bagar Market” notwithstanding a security threat, causing traffic jams & no provision to douse fire in case of adversity
