Accordingly after the report of Building section, JMC approved residential site plan in favour of owner vide No. 1154/JMC/BS/2023-24 dated 12-9-2023 allowing owner existing ground floor 1742 Sqft with additional area of 213 Sqft and new first and 2nd floors as 1742 Sqft respectively. The owner was duty bound to observe setbacks including front -18 ft, rear-7ft, side-1- 7 ft. The owner however wrongly claimed that on existing ground floor, he has left front -20 ft and back side 10 ft
Building section of JMC dated 1-9-2023 visited site and wrongly reported that ground floor is existing at site which is already approved by JMC and further reported that existing ground floor is as per norms as the owner has demolished the violated existing part at side set back and proposed construction yet to be raised when as per registry of plot , the plot was vacant during occupation by Mangal Dass
Surprisingly in report of Building Officer, there was no mention of actual and exact violation as it was simply reported that there was violations at side set back which was aimed to somehow shield violated construction of owner whereas there were serious nature violations on existing ground floor and which were compounded further by completely changing internal and external dimensions after getting approved first floor site plan which were ignored by JMC field staff

Jammu Municipal Corporation is playing with sanctity of approved site plans as the field staff hell-bent to allow owners their choice constructions against approved site plans and in most cases from residential to commercial besides allowing violations of site plans in the name of modification and extending areas of existing construction against JMP-2032 and Unified Building Bye-laws 2021 .
To put things in right perspective, one Mangal Dass son of Ganda Mal r/o 368 Shastri Nagar Jammu purchased residential plot 76/5 on main road of Channi Himmat Housing Board Colony measuring 40×80 Sqft in front of Varmani Shopping Mall from one Ishwar Chander Sharma son of Bodh Raj Sharma r/o 717-A, Gandhi Nagar Jammu costing worth Rs 170000 as per agreement in court of law and the same was transferred in his name in the record of Housing Board vide No. HB-6013-14 dated 24-3-2006 after paying Rs 32000 as transfer fee.
The owner accordingly got approved residential site plan from JMC in Sep 2023 and constructed violated ground floor covering an area of 1529 Sqft with additional porch area which was constructed front side measuring nearly 200 Sqft but mandatory setbacks as mentioned in approved site plan were not maintained. The owner constructed main wall towards plot No. 77/5 when it should be compound wall. The owner with an aim to raise commercial construction applied for another site plan seeking to extend size of ground floor and seeking permission to construct two more floors firs and 2nd.
As a result of which Building section officials of JMC dated 1-9-2023 visited site and reported that ground floor measuring 1529 Sqft excluding porch area 200 sqft is existing at site which is already approved by JMC and further reported that existing ground floor is as per norms as the owner has demolished the violated existing part at side set back and proposed construction yet to be raised. The site is abutting 9.0 Mts wide lane and the site falls under Channi Himmat Housing Board colony, Jammu. It deserves mentioning here that the building section of JMC wrongly reported that exiting violation in ground floor was demolished whereas in reality no violations demolished but even then JMC approved site plan

The owner with help of enforcement staff deputed in the area in the name of modification of ground floor completely changed internal dimensions at ground floor and as a result of which now violated commercial construction of first floor is going on completely against approved site plan and without any doubt, the owner is raising commercial construction on residential plot. Surprisingly in the report of Building Officer, there was no mention of actual and exact violation as it was simply reported that there was violations at side set back which was aimed to somehow shield violated construction of owner whereas there were serious nature violations on existing ground floor and which were compounded further by completely changing internal and external dimensions after getting approved first floor site plan which were ignored by JMC field staff.

Commissioner JMC should seriously introspect the functioning of JMC as the field staff allowing violated construction at per their will and most importantly as per the sweet will of owner and when both joined hands, JMC enforcement staff conveniently forgotten the guidelines of JMP-2032 and Unified Building Bye-laws 2021.

- JMC fails to implement verdict of High Court Jammu dated 9-10-2024 in case of residential house 584/4, Ward-50 Channi Himmat by allowing owner to continue running big shop under name & Style Durga Dutt Mart after converting drawing room making land use change from residential to commercial when JMC was at liberty to proceed against owner in case he doesn’t restore back drawing room by closing shop on residential ground floor and use premises purely for residential purpose only and de-seals shop when owner doesn’t fulfills conditions of de-sealing order
