Unwavering support of JMC enforcement staff allowing one late Makhan Lal Sharma and Sayeed Shah from Anantnag owner of existing violated building situated in Sector-6, Ward-50 a piece of private land of old village Channi Himmat previously owned by Gujjars family of Noora Gujjar and Nazir Gujjar to raise 2nd unauthorized commercial structure using teen shed and steel pipes without JMC permission adjoining with plot No. 257/6 and plot No.200/6 who have been worst hit by this unauthorized commercial construction without JMC permission. It deserves mentioning here that there are exiting unauthorized twenty shops each on two floors ground and first floor in a shopping complex under name and style Friends Complex which are functioning properly. Now the owner from last one week has started raising 2nd floor measuring nearly 2000 Sqft on existing area of two floors where there are twenty commercial shops each on floors using modern day technological construction with the use of steel pipes and iron shed without JMC permission. Worthwhile to mention here that under Building Bye-laws 2021, in case of redevelopment, erection or re-erection of existing building whether temporary or permanent as well as to the design, construction of or reconstruction and additions and alternations to a building, the permission of JMC is necessary but the owners started raising unauthorized 2nd floor without JMC permission but with help of enforcement staff deputed in area. Aggrieved people of Sector-6 and Sector-7 expressed resentment over this unauthorized construction and brought the same into kind notice of enforcement staff but nothing was done in this regard and as a result of which these aggrieved people approached management of this newspaper along with relevant detail and pictures of ongoing construction with a appeal to protect their right to live peacefully.. Moreover the owners were duty bound to seek prior permission of JDA for land use change and had they done so, worth lacs would have been deposited in Govt exchequer but due to help and support of enforcement staff , Govt exchequer was deprived of this amount in lacs.One thing is sure that J&K Govt is totally non-serious in implementing JMP-2032 in letter and spirit live example of which is quite visible in Channi Himmat Govt Housing Colony where hundreds of unauthorized structures have been raised with the support and encouragement of JMC enforcement staff which has always been hand in glove with violators resulting in huge commercial constructions on residential plots much to the despair and agony of locals now strongly regretting buying a residential plot in the area. Instances of open violations of approved site plans have been brought from time to time in kind notice of JMC authorities and that too from initial stage of violations but JMC enforcement staff rather than reporting violations to their higher authorities have managed violations at their own by embracing violators at the cost of serious damage to JMP-2032 and huge loss to Govt exchequer besides resulting in unplanned development in area .

- Nepotism and favoritism at its best in PHE Division Akhnoor in case of Kamini Kumar at present working Head Assistant at PHE Division Nowshera has wrongly drawn his salary/leave salary from 2011 to 2024 and has served in PHE Division Akhnoor w.e.f. 1988 to 2024 as daily wager, class ivth, Junior Assistant, Senior Assistant and not served anywhere except his present place of posting in Nowshera PHE Division despite his transfers with promotions
- JMC continues to act as mute spectator, violators raising choice construction with help of enforcement staff against JMP-2032, UBBL-2021, JMC Act 2000
- JMC fails to implement verdict of High Court Jammu dated 9-10-2024 in case of residential house 584/4, Ward-50 Channi Himmat by allowing owner to continue running big shop under name & Style Durga Dutt Mart after converting drawing room making land use change from residential to commercial when JMC was at liberty to proceed against owner in case he doesn’t restore back drawing room by closing shop on residential ground floor and use premises purely for residential purpose only and de-seals shop when owner doesn’t fulfills conditions of de-sealing order
- JMC fails to serve notices under JMC Act 2000 to owner of residential plot 629/3, Channi Himmat for raising three floors commercial structure without maintaining setbacks , changing both internal and external dimensions after getting residential site plan approved from JMC but not raising residential construction except keeping space for temporary windows and keeping two way entry completely deviating from approved site plan contrary to JMP-2032,UBBL-2021, JMC Act 2000
- Both JMC & J&K Housing Board act as mute spectator towards running of HIGH5 ARCADE+SOFTPLAY+CAFE at residential plot 649/3, Sector-3, Ward-50 Channi Himmat Colony after owner earlier raised commercial halls without internal partitions completely deviating from approved residential site plans both stage-1st and stage-2nd against JMP-2032,UBBL-2021 & JMC Act 2000 with JMC serving owner delayed notice without any follow-up and Housing Board completing formalities of dispatching letters to JMC seeking action against owner resulting in continuance of commercial activities from residential plot from last 8 months
- JMC’s BOCA notices and undertakings by owners fail to stop unauthorized constructions in absence of their implementation on ground as witnessed on residential plot 203/2 on main road side Channi Himmat Ward-50 where JMC after serving BOCA notice to owner didn’t take any action after owner submitted undertaking resulting in running of RK Fabrics earlier from shop of residential ground floor now from whole of ground floor residential making land use change and raising first floor without JMC permission without maintaining setbacks
