Delayed action on part of JMC and particularly delay on part of JMC enforcement staff to timely report violated construction has resulted in boom in unauthorized construction in Channi Himmat area. This in turn has encouraged violators as when the cat is away the mice must play. Meantime action taken against violators at advance stage of construction gives enough time to violators to manage saving their violated construction taking into confidence concerned enforcement staff who after shaking hands don’t report violations before their seniors resulting in flood in unauthorized constructions in Channi Himmat area.
To put the things in perspective, one Vipan Kumar already running shop situated at private land of village Channi Kamala adjoining with railway crossing under name and Style Kailash Refrigeration dealing in repairing ACs, Refrigerators and other electronic items on main road of Channi Himmat Zonal Plan colony, Ward-51, Sector-3 in front of Shiv Temple covering 100% area without any parking facility. Now, owner at present raising steel structure on existing shop without JMC permission from last couple of days also extending area of shop. It deserves mentioning here that earlier some six months back, the owner raised walls on four sides besides extending size of shop from backside towards Railway track. However, then Enforcement Inspector after series of complaints against owner had stopped the construction of shop on existing shop.
It deserves mentioning here that due to leniency on part of enforcement staff deputed in Ward-51, the owner of shop adjoining with shop of Vipan Kumar has also started construction of shop on existing shop without JMC permission by raising walls up to six ft and simultaneously also white-washing present construction to establish construction being old when enforcement stop in case visits the site . This trend is quite prevalent in area as new site plans on existing shops is not approved by JMC besides under changes rules especially after coming into being UBBL-2021 ,fresh construction has been restricted up to 70% besides it also costs owners to pay in JMC exchequer besides land use change certificates which costs lacs.
So to avoid all this the owners instead of following laid down procedures, they instead apply shortcuts and take into confidence concerned enforcement staff to get their violations completed by greasing their palms which they gracefully accept and conveniently forget their professional duties.
Similarly one Ram Raja Builders already having three shops adjoining with railway crossing on main road situated at private land of village Channi Himmat, Ward-51 in front of Shiv Temple without any parking facility has recently raised ground floor measuring 1500 Sqft to cover vacant area behind three shops facing railway track on main road of Channi Himmat Colony. Earlier on public complaints then Enforcement Inspector had stopped work and which remained stopped for some time with 9 ft walls raised waiting for slab work until April 2025 when owner completed slab work on ground floor on last week of April 2025. The fact of the matter is that as on date the owner is undergoing plaster and allied finishing works which is clearly visible from main road of Channi Himmat in Ward-51 as the shutter of one of three existing shops has been lifted and raw material with labour doing work is quite visible.
The owner as per reliable sources has also extended side of ground floor reaching nearer to railway track but so far JMC has not taken care of this when this unauthorized work is going on without JMC permission. Reliable sources have also disclosed that Ram Raja Builders has sold out vacant space to someone else who is undergoing present construction which is evident from the look of raised construction from backside indicating recent slab work completed.
In light of above, Commissioner JMC should mobilize enforcement staff in Ward-51 particularly Dy Commissioner South who is also incharge of enforcement wing in Channi Himmat area to stop such unauthorized constructions is stopped henceforth failing which other potential violators will follow suit which in turn will make extremely difficult for JMC to implement JMP-2032 and UBBL-2021 in letter and spirit, If such practices are not discouraged, then nobody will seek permission of JMC for getting site plan approved from it as when one can raise their choice constructions, what’s the fun of getting site plan approved from JMC especially when enforcement staff is not at all interested in taking action against owners and reporting their violations in time for action as per laid down norms.
