Aggrieved candidates led by one Rahul Sudan complained to Secretary to Govt, Health and Medical Education, Civil Secretariat Jammu/Srinagar claiming that Nitika Sharma having obtained PSP reservation Certificate by fraudulent means and got selected for the post of Medical Officer and posted at AHWC, Kalal Rajouri vide Govt Order No. 30-JK (HME) of 2024 dated 18-1-2024 demanding cancellation of PSP reservation certificate as her family income was much ahead of Rs 8 lacs income bar annually as father pension holder besides her mother was also a govt employee
When telephonically contacted with the then Tehsildar to enquire about the facts, he categorically admitted that this certificate was issued by him to Nikita Sharma on the basis of report of field staff where the applicant enclosed only pension copy of their father as a proof of Income. There was no extra source of family Income shown by the applicant in the application.
But later when it came to Tehsildar notice that the father of applicant was serving on extension basis in the same office and accordingly had another source of Income besides pension. Further, her mother was also serving in ICDS Deptt . The overall family Income of the applicant exceeded the limit of 8.00 Lacs per annum and therefore, this PSP certificate being illegal needed cancellation.
Tehsildar further stated that in view of these facts in mind, he wrote a letter to Deputy Commissioner, Rajouri vide No. TS/2023-24/02/164-166 dated 18-1-2024 when he was Tehsildar Siaot for Revision under section 18 of Reservation Act, 2004 which clearly empowers the Deputy Commissioner (DC) to take further action

In a bid to extend reservation benefits to Pahari speaking population in the Union Territory, J&K Govt approved various amendments in the reservation rules.These Pahari speaking people are spread over areas like in Rajouri, Poonch, Baramulla, Kupwara districts, besides some pockets of Anantnag, Budgam, Bandipora, Ganderbal, Kulgam, Pulwama and Shopian. After the reorganization of erstwhile Jammu and Kashmir state into two Union Territories and the enactment of Jammu and Kashmir Reservation (Amendment) Act, 2004, existing reservation percentage available to different categories was rationalized so as to include Pahari speaking people into the category of socially and educationally backward classes keeping their reservation quota at 4%. It deserves mentioning here that in a clarification over reservation for Pahari speaking people dated 16-7-2020 the Section (2) of Jammu and Kashmir Reservation Act, 2004 has defined the Socially and Educationally Backward Classes as category for providing reservation, which include persons residing in the backward areas, persons residing in the areas adjoining Actual Line of Control, Weaker and Under Privileged (Social Caste) as declared under various notifications from time to time.
The second proviso to the section 2 (0) has provided that for persons to be excluded from the category of socially and educationally backward classes and one of such category was the persons whose annual income from all sources determined in the prescribed manner exceeds Rs 8.00 lakhs (as per SRO-07 of January 7, 2019).Worthwhile to mention here, that this PSP Certificate was misused by influential persons by tampering with records with the help of revenue certificate and false statements of annual income from all the sources of family as at that time the annal income of her family was much beyond 8.00 lac income bar as her father and mother both were govt employees and father at that time was drawing monthly pension of Rs 62252 from 1-5-2021 and didn’t mention the salary of mother who was also govt employee. The live example of this is one Nitika Sharma d/o Tilak Raj Sharma r/o 10 VPO Prat, Sunderbani managed her selection among 17 other candidates as Medical officer (Ayurvedic) in Health and Medical Education Department by managing fake Pahari Speaking People Certificate vide No. OP/PSP/2021-22/148 dated 30-7-2021 issued by then Tehsildar Sunderbani Ravi Shanker as a result of notification No.22-PSC(DR-P) of 2022 dated 29-8-2022 whose result declared vide letter No.PSC/DR/Ayurvedic/H&ME/2022 dated 6-9-2023 with merit 43.54 at serial No. 16 of selection list and accordingly posted as AHWC Kalal Rajouri vide Govt order No. 30-JK(HME) of 2024 dated 18-1-2024 in pay level-9 (52700-166700).
Pertinent to mention here that along with Nitika Sharma there were twenty two candidates also who were also having PSP certificate and were genuine cases and as a result of which these aggrieved candidates led by one Rahul Sudan complained to Secretary to Govt, Health and Medical Education, Civil Secretariat Jammu/Srinagar claiming that Nitika Sharma having obtained PSP reservation Certificate by fraudulent means and got selected for the post of Medical Officer and posted at AHWC, Kalal Rajouri vide Govt Order No. 30-JK (HME) of 2024 dated 18-1-2024 demanding cancellation of PSP reservation certificate as her family income was much ahead of Rs 8 lacs income bar annually besides her mother was also a govt employee.
Meanwhile when aggrieved candidates approached management of this newspaper, our correspondent established contact with then Tehsildar Sunderbani Ravi Shanker and sought his clarification over the issue. When telephonically contacted with the then Tehsildar to enquire about the facts, he categorically admitted that this certificate was issued by him to Nikita Sharma on the basis of report of field staff where the applicant enclosed only pension copy of their father as a proof of Income. There was no extra source of family Income shown by the applicant in the application. But later on it came to my notice that the father of applicant was serving on extension basis in the same office and accordingly had another source of Income besides pension. Further, her mother was also serving in ICDS Deptt .To sum up, the overall family Income of the applicant exceeded the limit of 8.00 Lacs per annum and therefore, this PSP certificate being illegal needed cancellation. He further stated that in view of these facts in mind, he wrote a letter to Deputy Commissioner, Rajouri vide No. TS/2023-24/02/164-166 dated 18-1-2024 when he was Tehsildar Siaot for Revision under section 18 of Reservation Act, 2004 which clearly empowers the Deputy Commissioner (DC) to take further action. Currently, the file is pending before DC Rajouri for its disposal.
